Appeals <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported <br />that no protests or objections had been received. <br />Community Development Director Aguilera reported on the Appeal filed <br />by Mr. Vince Eupierre, for Burger King, on the Planning Commission's <br />denial of File Index No. V-3-89, Variance application for a 65 foot <br />high pole sign to be located at the southeast corner of 9th Street <br />and Valley Boulevard. <br />Mr. Aguilera advised the Planning Commission held a public hearing on <br />this matter February 14, 1989, and denied the Variance request based on <br />a report from the City's Traffic Committee, which indicated the freeway <br />sign would increase freeway traffic onto 9th Street and would cause <br />traffic circulation problems at that intersection. <br />Mr. Aguilera concluded if Council concurs with the Planning Commission <br />recommendation for denial, it would be in order to adopt Resolution No. <br />R-38-89, denying the appeal; however, if Council does not agree, it <br />would be in order to adopt the second form of Resolution No. R-38-89, <br />approving the Appeal. <br />Mayor Gonzales asked if anyone present desired to speak on this matter. <br />Speaking in opposition to the Variance request and pole sign was Dorene <br />Dominguez, Vanir Development Company, Inc., 290 North D Street, San <br />Bernardino, stating if the Council approved this request, then the other <br />businesses in the area would be requesting the same thing, such as <br />Stater Bros. and the Travel Lodge, across the street. <br />Mr. Aguilera advised the Zoning Ordinance would not permit higher signs---- <br />in the areas of Stater Bros. or the Travel Lodge. <br />Mr. Abe Beltran, 1010 North 12th Street, Colton, stated he was speaking - <br />on behalf of the applicant, Vince Eupierre, advising that they are paying <br />an amount of $26,000 to mitigate the traffic factor. Mr. Beltran said <br />in 1986 he received a letter from the Planning Department stating that <br />the existing sign would be "grandfathered" into the site. Mr. Beltran <br />stated it was his understanding that the City's Traffic Committee will <br />make a study of this site and immediate area. <br />Mayor Gonzales stated the existing sign has been there for many years <br />and it should be grandfathered in. Mayor Gonzales stated signs ad- <br />jacent to the freeway need to be higher than 45 feet in order to be <br />seen. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, the Public <br />Hearing was closed. Unanimous vote. <br />Moved by Mayor Gonzales, seconded by Councilman Rios, to grant Appeal <br />and adopt Resolution No. R-38-89. Unanimous vote. <br />RESOLUTION NO. R-38-89 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON GRANTING THE APPEAL FILED BY VINCE <br />EUPIERRE FOR BURGER KING REGARDING FILE INDEX <br />NO. V-3-89. <br />COMMUNITY DEVELOPMENT DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Mobile Home Parks <br />Community Development Director Jaime Aguilera gave a Progress Report on <br />the Environmental Review of the Rent Stabilization Ordinance. Mr. <br />Aguilera advised it has been determined to proceed with a Negative Dec- <br />laration process, and Mr. Ralph Castaneda, of Willdan & Associates, will <br />be assisting Staff in this regard. <br />Mr. Aguilera stated Staff will be making a presentation the second <br />Council Meeting in April, April 18, 1989, and they are working quickly <br />to accomplish this. <br />MAR 7 1989 <br />
