Appeals Mayor Gonzales declared the Public Hearing open. City Clerk Ramos submitted the Affidavit of Publication and reported that no protests or objections had been received. Community Development Director Aguilera reported on the Appeal filed by Mr. Vince Eupierre, for Burger King, on the Planning Commission's denial of File Index No. V-3-89, Variance application for a 65 foot high pole sign to be located at the southeast corner of 9th Street and Valley Boulevard. Mr. Aguilera advised the Planning Commission held a public hearing on this matter February 14, 1989, and denied the Variance request based on a report from the City's Traffic Committee, which indicated the freeway sign would increase freeway traffic onto 9th Street and would cause traffic circulation problems at that intersection. Mr. Aguilera concluded if Council concurs with the Planning Commission recommendation for denial, it would be in order to adopt Resolution No. R-38-89, denying the appeal; however, if Council does not agree, it would be in order to adopt the second form of Resolution No. R-38-89, approving the Appeal. Mayor Gonzales asked if anyone present desired to speak on this matter. Speaking in opposition to the Variance request and pole sign was Dorene Dominguez, Vanir Development Company, Inc., 290 North D Street, San Bernardino, stating if the Council approved this request, then the other businesses in the area would be requesting the same thing, such as Stater Bros. and the Travel Lodge, across the street. Mr. Aguilera advised the Zoning Ordinance would not permit higher signs---- in the areas of Stater Bros. or the Travel Lodge. Mr. Abe Beltran, 1010 North 12th Street, Colton, stated he was speaking - on behalf of the applicant, Vince Eupierre, advising that they are paying an amount of $26,000 to mitigate the traffic factor. Mr. Beltran said in 1986 he received a letter from the Planning Department stating that the existing sign would be "grandfathered" into the site. Mr. Beltran stated it was his understanding that the City's Traffic Committee will make a study of this site and immediate area. Mayor Gonzales stated the existing sign has been there for many years and it should be grandfathered in. Mayor Gonzales stated signs ad- jacent to the freeway need to be higher than 45 feet in order to be seen. Moved by Councilwoman Cisneros, seconded by Councilman Rios, the Public Hearing was closed. Unanimous vote. Moved by Mayor Gonzales, seconded by Councilman Rios, to grant Appeal and adopt Resolution No. R-38-89. Unanimous vote. RESOLUTION NO. R-38-89 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON GRANTING THE APPEAL FILED BY VINCE EUPIERRE FOR BURGER KING REGARDING FILE INDEX NO. V-3-89. COMMUNITY DEVELOPMENT DIRECTOR'S REPORTS AND RECOMMENDATIONS: Mobile Home Parks Community Development Director Jaime Aguilera gave a Progress Report on the Environmental Review of the Rent Stabilization Ordinance. Mr. Aguilera advised it has been determined to proceed with a Negative Dec- laration process, and Mr. Ralph Castaneda, of Willdan & Associates, will be assisting Staff in this regard. Mr. Aguilera stated Staff will be making a presentation the second Council Meeting in April, April 18, 1989, and they are working quickly to accomplish this. MAR 7 1989
