R-153-89 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, CALIFORNIA, AUTHORIZING CERTAIN OF <br />ITS MEMBERS TO FILE A WRITTEN ARGUMENT REGARD- <br />ING A CITY MEASURE. <br />Mrs. Ramos stated the final action to be taken in this matter concerns <br />the submission of rebuttal arguments, as outlined in Resolution No. R- <br />154-89, and if Council wishes to proceed with this, the date of March 1: <br />1990 is established as the last day for submission of rebuttal argument: <br />Moved by Councilman Lofy, seconded by Councilwoman Cisneros, to adopt <br />Resolution No. R-154-89. Unanimous vote. <br />RESOLUTION NO. R-154-89 <br />- A RESOLUTION OF THE CITY OF COLTON, CALIFORNIA, <br />PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS <br />FOR CITY MEASURES SUBMITTED AT MUNICIPAL ELEC- <br />TIONS. <br />Councilwoman Cisneros stated that possibly Attorney Neuerburg could <br />answer the questions posed by Mr. Rebello and Mr. Fredrickson regard- <br />ing freezing of rents or a moratorium. <br />Mr. James Neuerburg, of Best, Best and Krieger, stated during the interim, <br />for the outcome of Ordinance No. 0-19A-89, it is legally possible that <br />the provision of rent freeze could be considered, however, this could <br />not be guaranteed. Mr. Neuerburg stated this is still being studied <br />and there could be problems with the enactment. Mr. Neuerburg stated <br />that evidence, documentation, emergency conditions, etc., would be <br />needed, not merely verbal say-so. <br />City Manager Leslie Keane added the documented evidence could be sub- <br />mitted to her office. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Fees <br />Res. No. R-150-89 <br />City Manager Leslie Keane reported on Resolution No. R-150-89, revising <br />the fees for affected properties in Drainage Benefit Area No. 1, estab- <br />lished by Ordinance No. 0-27-88, in San Bernardino County Flood Control <br />District's Drainage Area 3-5. <br />Ms. Keane stated based on information submitted by the engineering firm <br />of NBS/Lowry, Staff is proposing a reduction to the current fees, which <br />shall now be $14,740 per gross acre. <br />Ms. Keane concluded Staff recommends adoption of Resolution No. R-150- <br />89, modifying fees imposed by Drainage Benefit Area No. 1. <br />Moved by Councilwoman Cisneros, seconded by Councilman Lofy, to adopt <br />Staff's recommendation and Resolution No. R-150-89. Unanimous vote. <br />RESOLUTION NO.
