<br />Certification of Referendum Petition
<br />City Attorney Edwards stated that he would excuse himself from this
<br />portion of the Agenda, and that Attorney James Neuerburg, of Best, Best
<br />and Krieger, would preside.
<br />Mr. Frank Rebollo, 2851 South La Cadena Drive, Space 2755 and Mr. Garland
<br />Fredrickson, 2851 South La Cadena Drive, Space 258, spoke to the City
<br />Council with regard to the circulators of petitions against the rent
<br />stabilization ordinance, and the way in which this procedure was con-
<br />ducted. These residents also spoke about the owners of the park and
<br />the way things were being handled, the impending rent increases, etc.,
<br />and asked if a freeze, or moratorium, in rents could be initiated until
<br />the matter of the rent control ordinance was settled.
<br />City Clerk Ramos then reported on Certification of the Referendum Peti-
<br />tition, filed October 19, 1989, on Ordinance No. 0-19A-89, providing for
<br />rent stabilization in mobile home park spaces.
<br />Mrs. Ramos continued the Certificate to Petition, which was determined
<br />to be sufficient, should be accepted and filed.
<br />Lo Moved by Councilman Lofy, seconded by Councilman Rios, to accept and file
<br />® Clerk's Certificate to Petition as received from the Registrar of Voters.

<br />Mrs. Ramos then presented for consideration Resolution No. R-152-89,
<br />Calling and Giving Notice of a Special Municipal Election to be held
<br />on June 5, 1990, in the event the City Council does not entirely repeal
<br />the Ordinance against which the Petition was filed.

<br />NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE
<br />HELD ON JUNE 5, 19909 AND REQUESTING THE BOARD
<br />OF SUPERVISORS OF THE COUNTY OF SAN BERNARDINO
<br />TO CONSOLIDATE SAID SPECIAL ELECTION WITH THE
<br />COUNTY CONSOLIDATED ELECTION TO BE HELD ON THAT
<br />DATE PURSUANT TO SECTION 23302 OF THE ELECTION
<br />CODE.
<br />Mrs. Ramos then recommended that an Impartial Analysis be prepared of
<br />Ordinance No. 0-19A-89, due to its length, to assist the voters in
<br />their discernment. Mrs. Ramos stated a motion to direct Attorney
<br />Neuerburg, of: Best, Best and Krieger, to prepare the Impartial Analysis,
<br />as outlined in Resolution No. R-155-89, would be in order.
<br />Moved by Councilman Lofy, seconded by Councilwoman Cisneros, to adopt
<br />Resolution No. R-155-89, and authorize preparation of an Impartial
<br />Anaylsis by Special Counsel. Upon Roll Call, the Vote was Unanimous.
<br />RESOLUTION NO. R-155-89 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br />OF COLTON) CALIFORNIA, DIRECTING THE CITY CLERK
<br />TO TRANSMIT A COPY OF A CITY MEASURE TO THE
<br />SPECIAL COUNSEL FOR THE CITY OF COLTON FOR
<br />PREPARATION OF AN IMPARTIAL ANALYSIS OF SAID
<br />CITY MEASURE.
<br />Mrs. Ramos advised Election Code Section 5013 provides that the City
<br />Council may authorize certain of its members to file written arguments
<br />for or against a City measure. Mrs. Ramos recommended this be so
<br />authorized by the City Council, as outlined in Resolution No. R-153-89,
<br />and advised that she had set the final date for submission of arguments
<br />as March 6, 1990.
<br />It was determined that Mayor Gonzales, Councilwoman Cisneros and Council-
<br />man Lofy would file written arguments.
