1 5 QCity Manager Leslie Keane reported that after the Council approved an <br />increase to the City refuse hauling rates, Staff was directed to in- <br />vestigate the possibility of limiting the number of private refuse <br />haulers doing business in the City. Ms. Keane continued Staff has <br />asked special Legal Counsel, Best, Best, & Krieger, to review the State <br />laws with respect to this issue, and have been informed that we may <br />terminate existing refuse hauling franchises in favor of providing City <br />service or issuing exclusive franchises with a limited number of firms. <br />Section 4272 of the State Health and Safety Code, however, requires that <br />the City notify all current refuse hauling franchises of our intention <br />to authorize exclusive solid waste enterprise. <br />Ms. Keane stated the City currently has five active refuse franchises, <br />the majority of which have been operating in excess of three years. <br />Ms. Keane concluded Staff is recommending the City Council adopt a polio <br />disallowing any new refuse hauling franchises in the City of Colton; <br />direct Staff to immediately notify all existing refuse haulers, doing <br />business in the City, of the City's intention to limit the number of <br />refuse franchises effective November, 1994; and direct Staff to return <br />to Council in approximately November of 1993, with a report and recom- <br />mendations regarding a comprehensive City-wide refuse hauling program. <br />Moved by Councilman Rehrer, seconded by Councilman Rios, to approve <br />Staff's recommendations with regard to refuse hauling franchises. Vote <br />was unanimous. <br />Closed Session <br />City Manager Leslie Keane stated there was no need for the Closed Session <br />as indicated on the Agenda. <br />San Salvador Catholic Church <br />Councilwoman Cisneros advised that a request from San Salvador Catholic <br />Church, to have a Ministry Fair on October 29, 1989, has been received <br />and needs to be acted upon. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, that the <br />need to take action arose subsequent to the posting of the Agenda re- <br />garding a request from San Salvador Catholic Church. Unanimous vote. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to approve <br />request from San Salvador Catholic Church for a Ministry Fair on Sunday, <br />October 29, 1989, from 8:00 a.m. to 1:00 p.m. Unanimous vote. <br />ORAL COMMUNICATIONS: <br />Councilman Rios spoke about a recent newspaper article regarding a possi- <br />ble dump site facility in Colton, and the interest of the firm, Western <br />Waste. <br />City Manager Leslie Keane responded that the City has not received any <br />type of formal application for a dump site from this company, and, at <br />any rate, this would involve a long process, beginning with the Planning <br />Commission, noticed hearings, EIR's, etc. <br />Councilwoman Cisneros said the City Council has stated they do not want <br />this. <br />Mr. Floyd Rhinehart, of the Sun -Telegram, stated this story had been <br />edited and cut, however, he did not feel the article indicated that <br />this matter was being considered by the City Council. <br />An.TnTTRNMF.NT : <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios and unani- <br />mously passed, Mayor Gonzales adjourned the Meeting at 8:10 p. m. <br />A r. <br />0. 7 � <br />�u1% - <br />HELEN A.
