1 5 QCity Manager Leslie Keane reported that after the Council approved an increase to the City refuse hauling rates, Staff was directed to in- vestigate the possibility of limiting the number of private refuse haulers doing business in the City. Ms. Keane continued Staff has asked special Legal Counsel, Best, Best, & Krieger, to review the State laws with respect to this issue, and have been informed that we may terminate existing refuse hauling franchises in favor of providing City service or issuing exclusive franchises with a limited number of firms. Section 4272 of the State Health and Safety Code, however, requires that the City notify all current refuse hauling franchises of our intention to authorize exclusive solid waste enterprise. Ms. Keane stated the City currently has five active refuse franchises, the majority of which have been operating in excess of three years. Ms. Keane concluded Staff is recommending the City Council adopt a polio disallowing any new refuse hauling franchises in the City of Colton; direct Staff to immediately notify all existing refuse haulers, doing business in the City, of the City's intention to limit the number of refuse franchises effective November, 1994; and direct Staff to return to Council in approximately November of 1993, with a report and recom- mendations regarding a comprehensive City-wide refuse hauling program. Moved by Councilman Rehrer, seconded by Councilman Rios, to approve Staff's recommendations with regard to refuse hauling franchises. Vote was unanimous. Closed Session City Manager Leslie Keane stated there was no need for the Closed Session as indicated on the Agenda. San Salvador Catholic Church Councilwoman Cisneros advised that a request from San Salvador Catholic Church, to have a Ministry Fair on October 29, 1989, has been received and needs to be acted upon. Moved by Councilwoman Cisneros, seconded by Councilman Rios, that the need to take action arose subsequent to the posting of the Agenda re- garding a request from San Salvador Catholic Church. Unanimous vote. Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to approve request from San Salvador Catholic Church for a Ministry Fair on Sunday, October 29, 1989, from 8:00 a.m. to 1:00 p.m. Unanimous vote. ORAL COMMUNICATIONS: Councilman Rios spoke about a recent newspaper article regarding a possi- ble dump site facility in Colton, and the interest of the firm, Western Waste. City Manager Leslie Keane responded that the City has not received any type of formal application for a dump site from this company, and, at any rate, this would involve a long process, beginning with the Planning Commission, noticed hearings, EIR's, etc. Councilwoman Cisneros said the City Council has stated they do not want this. Mr. Floyd Rhinehart, of the Sun -Telegram, stated this story had been edited and cut, however, he did not feel the article indicated that this matter was being considered by the City Council.
