Mr. Olivier stated the documents before the Council/Agency this evening <br />contain the proposal submitted by the City, however, the developers, <br />Gatlin/Berger, are not in agreement with several of the items. Mr. <br />Olivier stated extensive negotiations have taken place and many issues <br />discussed, however, there remains four major items to be resolved and <br />agreed upon by both parties. <br />Mr. Olivier then reviewed the four major issues of significance for <br />the Council/Agency, which were: <br />1. Sales and Use Tax Note - term of Note and Percentage of <br />Tax Revenue. <br />2. Reimbursement for relocation of certain utilities and <br />improvements - City of Riverside water main and other im- <br />provements in Centrepoint Drive. <br />3. Time of Performance Build -out and Opening of Wal-Mart Store. <br />4. Use restrictions for one of the two proposed restaurants - <br />that at least one restaurant be a sit-down restaurant and <br />not a drive-through. <br />Mr. John Brown, Legal Counsel, of Best, Best & Krieger, said he realizes <br />this is a great deal of information to digest at one time, and a develop- <br />ment of this magnitude requires extensive study and negotiation before <br />making a final decision. Mr. Brown suggested leaving this hearing open <br />and allow Staff to summarize, in writing, the presentation made this <br />evening so that the Council/Agency will have all of the information <br />in written form, before them, which may assist each one in reaching a <br />more viable decision. <br />Mr. Frank Gatlin, 5650 E1 Camino Real, Carlsbad, California; Mr. Steven <br />Ziven, 8383 Wilshire Boulevard, Beverly Hills, California; and Mr. Daryl <br />Berger, 6000 St. Charles Steet, New Orleans, Louisiana; each addressed <br />the Council/Agency with regard to the proposed development and the <br />issues at hand, stating they were hopeful this matter could be resolved <br />tonight. <br />Discussion then followed among Council/Agency Members and Staff. <br />Mayor Gonzales stated he was willing to move ahead on this matter and <br />moved for approval of the Disposition and Development Agreement as <br />presented. Motion died for lack of a second. <br />The Council/Agency recessed at 7:35 p.m., and reconvened at 7:48 p.m., <br />all Members present. <br />Mayor Gonzales declared the City Council Public Hearing closed. <br />2 <br />�Q <br />
