PUBLIC HEARINGS: <br />Appeal — File Index No. DAP -000-668 — Global Premier Development <br />This was the Time And Place Fixed To Consider The Continued Public Hearing Of July 17, <br />2007, Regarding The Planning Commission's Decision On Request For Design Review, Lot <br />Merger, Environmental Assessment And Minor Variance To Reduce The Rear Setback To <br />Combine Four Lots Into One Lot To Develop A 38 -Unit, Low -Income Housing, Apartment <br />Complex On 839 East Fairway Drive, Colton <br />Mayor Chastain declared the public hearing open. <br />City Clerk Padilla announced that the Notice of Continuance for the public hearing was on file in <br />the City Clerk's office and no protests or objections have been received. <br />Community Development Director Zamora announced the withdrawal of their application and <br />requested direction to staff to prepare resolution to that effect. <br />City Attorney Martinez explained that originally this was an appeal of an underground structure, <br />however, since the original hearing they have redesigned the project plan and would like the <br />City to review the revised application; this is the reason for the direction to prepare a resolution <br />to deny the application and the appeal, caution should be taken as the new application must <br />undergo design review, go before the Planning Commission for approval, and possible for final <br />review and approval by the Council. Direction from Council to include Council review unless the <br />Planning Commission approval/denial results in an appeal. <br />PUBLIC COMMENT <br />None <br />Motion/second by CM Mitchell/Mayor Pro Tempore Suchil to close the public hearing. Motion <br />carried with De La Rosa absent from the dais. <br />Discussion continued regarding the acceptance of the withdrawal of appeal by appellant without <br />prejudice and direct staff to schedule the revised plan before Planning Commission and City <br />council and prepare a resolution stating the aforementioned. <br />Motion/second by CM OlivaNzaguirre to accept the withdrawal of appeal by appellant without <br />prejudice and direct staff to schedule the revised plan before the Planning Commission and City <br />Council and prepare said resolution to that affect. Unanimous vote. <br />Amendment of Title 18 <br />This was the Time And Place Fixed To Consider An Ordinance Of The City Council Of The City <br />Of Colton To Amend Title 18 Of The Colton Municipal Code To Clarify And Update Existing <br />Code Sections Relating To: Front Setback Requirements For Parking Facilities; Parking <br />Requirements For Warehouse, Storage And Miniwarehouse Buildings; Side And Rear Setback <br />Requirements For Properties Located In Commercial And Industrial Zones; The Procedure For <br />Approval Of Telecommunication And Antenna Towers; And Expiration, Revocation And Appeals <br />Of Land Use Applications <br />2007 AUG 21 REG CC/RDA/CUA MEETING - 3 - <br />
