Leticia Chavez, read a statement on behalf of local resident in the area and spoke against the <br />project. <br />Damon Howard, resident, spoke against the project. <br />Discussion continued with Council expressing concerns regarding design of brick wall, <br />conditions identified in covenant, broken windows, graffiti, and security, future senior housing <br />project, parking space allowances, signalization, and street widening. Staff responded. <br />City Manager Parrish responded as to involvement needed for senior project, and asked for <br />staff to certify the meetings were properly noticed by Planning Commission and Council. <br />Discussion continued with Council commenting on the need for senior housing, low income <br />homes, and project restrictions. <br />City Attorney Derleth asked that City Attorney Martinez explain the restrictions as outlined in the <br />agreement. <br />City Attorney Martinez explained that this was not a city project, it was a developer project and <br />unable to tell them what type of project. Based on the type of project that is before the council it <br />meets the design and has a density bonus that allows other variances, without the density <br />bonus agreement the city would not be able to be specific. Constraints under California Law <br />and Housing Law are that cities do not have the ability to turn down projects unless based on <br />specific heath and safety standard, i.e. sewer dumping by project exceeds the health and safety <br />codes at which time council can say "no". City Attorney Martinez further clarified that project <br />issues presented at last meeting by Police Department were redesigned and presented today <br />and nothing in the report is in violation, if there is a need project needs to be returned to staff <br />and continued the public hearing for clarification. <br />Discussion continued with Council requesting clarification on the qualifications for low income <br />housing and suggestion to table the issue to investigate any health and safety issues that may <br />exist in the project. Mayor Pro Tempore Suchil seconded the motion. <br />City Attorney Martinez read the law as to the health and safety housing element findings issues <br />as it relates to low and moderate housing. <br />Mayor Chastain clarified the motion to reopen the public hearing and continue to the February <br />19, 2008 Regular Council Meeting, in order to send back to staff to review if there are additional <br />health and safety findings as outlined in the law as it relates to low and moderate housing in <br />regards to this project. <br />VOTE: Motion carried with CM Toro voting "NO". <br />ORDINANCE: <br />Waive Full Reading and Pass Second Reading of an Ordinance No. 0-20-07 regarding the City <br />Clerk's Supplemental Duties, ORDINANCE NO. 0-20-07. <br />Motion/second by CM Mitchell/De La Rosa to waive full reading and pass second reading of <br />Ordinance 0-20-07. <br />2007 DEC 18 REG CC/RDA/CUA MEETING -4- <br />
