Discussion by Council continued with questions directed to Inland Memorial representatives regarding <br />their business, how long it has existed, government codes they operate, the rough grading currently <br />being done, explanation of how property is sold in the cemetery, are refunds available if land is not <br />available, and knowledge of original Memorandum of Understanding and will Inland Memorial would <br />continue to abide by it. <br />General Manager Pratt explained the procedure of inter park transfer in the event of no availability in <br />proposed future cemetery development, and assured member there was no rough grading. <br />At 6:05 p.m. CM Yzaguirre left the roundtable. <br />Discussion continued by Council expressing concerns over the misinformation presented at the <br />meeting held at the Cemetery, the potential liability on the plots already sold in the fly habitat as <br />presented in the good faith agreement with past CEO Mark Durbin and the stressed the importance of <br />working together with the City, and requested an estimate of burials in the seven acres. <br />General Manager Pratt replied that the cemetery would have to crunch and maximize to accommodate <br />in order to give the people space and he would need to get a surveyor to provide the numbers. He <br />further expressed the importance of working together with the City and assured that they would be <br />better educated on the DSF after their meeting with Fish and Wildlife. <br />Council discussion continued reminding Cemetery Representatives that the ruling were by the federal <br />government not the city, and City was prepared to work with the cemetery. <br />Attorney for Inland Memorial Bill Lemon apologized for all of the misunderstanding and misperceptions. <br />Attorney Lemon assured the council that they would be able to talk and discuss further after the <br />meeting with Fish and Wildlife. The Cemetery's long term plan was to understand the development, <br />endowment and long term maintenance. <br />City Attorney Martinez suggested that Council direct legal counsel to meet with Attorney Lemon to <br />prepare an action plan consisting of who would be the point of contact, jointly set up a meeting with the <br />Fish and Wildlife within the next 30 days, along with a meeting with the point of contact before the <br />meeting with Fish and Wildlife, the Cemetery will begin to cure the issues presented, and after meeting <br />with the Fish and Wildlife set up a meeting to begin to discuss alternative. <br />City Manager Parrish requested that timelines be added to the plan of action, along with requesting that <br />Inland Memorial agree to stop rhetoric, negotiating business with the press, incomplete explanations, <br />ignoring emails, calls or correspondence, contact response quickly and respectfully, no sensationalism <br />need to focus on good business. <br />Attorney Lemon explained that he would work with City Attorney Martinez to discuss and formulate a <br />twelve point plan. <br />PUBLIC COMMENT: <br />The following citizens addressed the council: Apolinar Espudo, offer to volunteer to attend meeting. <br />City Attorney Martinez explained that the public was not allowed at these meetings, however, staff <br />could prepare a follow-up letter. <br />At 7:01 p.m. CM Mitchell left the meeting. <br />CM De La Rosa asked if Fish and Wildlife could provide a presentation at a Regular Council Meeting to <br />inform the public of their discussion and rulings. <br />2008 JANUARY 02 SPC CC/RDA/CUA MEETING - 3 - <br />
