A. CONFERENCE WITH LEGAL COUNSEL - POTENTIAL LITIGATION <br />Pursuant to Government Code Section 54956.9(c) <br />Number of Cases: 1 <br />ACTION: No Reportable. <br />BUSINESS ITEMS <br />(1) Ethics Policy <br />Consensus by Mayor and Council to approve the Code of Norms and Ethics and Pledge, with the <br />following general revisions to the code: <br />• Meet with Commission appointees annually, Commission Chairperson should make a <br />written report to the Mayor and Council bi-annually regarding completed commission <br />business items. <br />• Meet and confer with City Manager regarding requests or assignments for staff. <br />• Appointment of Mayor Pro Tempore — Follow formally adopted policy, direct staff to <br />review Municipal Code and return with a proposed policy to be formally adopted for the <br />fair and objective rational selection of Mayor Pro Tempore. <br />• Removal of Mayor communication with Commission Chairs <br />• Changes in Public Comment — Each City Council Member shall conduct themselves and <br />allow the meeting to be conducted in a manner that is most efficient with respect to time <br />but which also allows the most members of the public to express their views in the time <br />allotted for the meeting. <br />Direction given to City Attorney to distribute revised copies showing changes, to be reviewed by <br />Council Members. If they do not reflect a consensus, it will return to a future Council meeting <br />for ratification. <br />At 7:15 p.m., Mayor Chastain left the dais and Mayor Pro Tempore conducted the meeting in her <br />absence. At 7:22 p.m. Mayor Chastain assumed her place at the dais. <br />Motion and second by CM Yzaguirre/CM Perez to approve Ethics Policy as corrected by City <br />Attorney. <br />City Attorney Derleth stated that Mayor and each Council Member will receive a redline and a <br />"clean" version and if Council feels it was not articulated enough, he will bring it back at next <br />meeting. As a formality, it was agreed that all members sign the ethics policy. City Attorney <br />Derleth stated that tonight it is also recommended that we approve the pledge attached to the <br />backup. No one is mandated to sign. No objections to the motion. <br />(2) Manual Of Procedures (MOP) <br />Consensus by Mayor and Council to approve the Manual of Procedures, with the following <br />general revisions to the Municipal Code: <br />• Clarification as to how and when a Council Member has the authority to place an item on <br />the agenda.
