Section 209 of Ordinance No. 1327 relating to <br />subdivisions is amended to read as follows: <br />Section 209: Conditional Circumstances. <br />1. Conditional exceptions to the provisions herein defined may <br />be authorized if exceptional or special circumstances apply to the property. <br />Such special circumstances may include. <br />a. Condominiums, co-ops, planned unit developments, <br />town houses and similar type developments. <br />b. Limited size, unusual shape, extreme topography, <br />including hillside developments. <br />c. Extreme and dominating problems such as drainage, <br />street alignment, and accessability. <br />2. Subdivisions: The term "subdivision shall have the meaning <br />ascribed to it by the provisions of Sections 11535; 11535. 1 and 11535.2 of the <br />State Business and Professions Code (Subdivision Map Act), provided further <br />that pursuant to the provisions of Section 11540. 1 of the State of California <br />Business and Professions Code, and to the extent authorized thereby, any <br />division of land into two (2) or more parcels, lots or building sites, and any <br />condominium project containing two (2) or more condominiums, whether the <br />project is to be constructed or involves the conversion of an existing structure, <br />shall be processed in the same manner as a "subdivision". <br />Any deed of conveyance, sale or contract made contrary to <br />the provisions of this chapter is voidable to the extent and in the same manner <br />
