THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 209 of Ordinance No. 1327 relating to subdivisions is amended to read as follows: Section 209: Conditional Circumstances. 1. Conditional exceptions to the provisions herein defined may be authorized if exceptional or special circumstances apply to the property. Such special circumstances may include. a. Condominiums, co-ops, planned unit developments, town houses and similar type developments. b. Limited size, unusual shape, extreme topography, including hillside developments. c. Extreme and dominating problems such as drainage, street alignment, and accessability. 2. Subdivisions: The term "subdivision shall have the meaning ascribed to it by the provisions of Sections 11535; 11535. 1 and 11535.2 of the State Business and Professions Code (Subdivision Map Act), provided further that pursuant to the provisions of Section 11540. 1 of the State of California Business and Professions Code, and to the extent authorized thereby, any division of land into two (2) or more parcels, lots or building sites, and any condominium project containing two (2) or more condominiums, whether the project is to be constructed or involves the conversion of an existing structure, shall be processed in the same manner as a "subdivision". Any deed of conveyance, sale or contract made contrary to the provisions of this chapter is voidable to the extent and in the same manner
