I ORDINANCE NO. 0-08-08 <br />2 AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, CALIFORNIA, CANCELING <br />3 THE CITY'S INSPECTION AND ENFORCEMENT <br />AUTHORITY PURSUANT TO THE MOBILEHOME <br />4 PARKS ACT AND SPECIAL OCCUPANCY PARKS <br />ACT AND TRANSFERRING SUCH AUTHORITY <br />5 TO THE CALIFORNIA DEPARTMENT OF <br />HOUSING AND COMMUNITY DEVELOPMENT <br />6 <br />7 THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />8 FOLLOWS: <br />9 SECTION 1. Urgency Findings. In accordance with California Government Code <br />10 Section 36937 and in order to protect the public the public peace, health and safety, the City <br />11 Council of the City of Colton ("City") finds as follows: <br />12 A. The County of San Bernardino has recently announced that it is going to <br />13 discontinue enforcement of the Mobilehome Parks Act (Health and Safety Code Section <br />14 18200 et seQ.) and the Special Occupancy Parks Act (Health and Safety Code Section 18860 <br />15 et seq.) (the "Acts") beginning July 31, 2008. <br />16 B. Pursuant to California Health and Safety Code Sections 18300(e) and <br />17 18865(3) and California Code of Regulations, Title 25, Section 1005, the City may, upon <br />18 written notification from its governing body to the Department of Housing and Community <br />19 Development ("Department"), cancel the City's assumption of responsibility of <br />20 enforcement of the Acts and transfer such responsibilities to the Department. <br />21 C. Such written notification to the Department is due from the City no less than <br />22 (thirty) 30 days prior to the effective date of any action relinquishing enforcement <br />23 responsibility, pursuant to California Code of Regulations, Title 25, Section 1005. <br />24 D. The City Council finds that it is necessary for the immediate preservation of <br />25 public peace, health and safety that the City, at this time, to cancel its enforcement <br />26 responsibility for the Acts and transfer such responsibility to the Department. <br />27 E. The City currently contains at least five (5) mobile home parks or special <br />28 occupancy parks, the residents of which need inspection and enforcement services. <br />—1— <br />
