1 <br />2 <br />3 <br />4 <br />51 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />►: <br />ORDINANCE NO. 0-09-08 <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF COLTON AMENDING <br />SECTIONS 4, 11 AND EXHIBIT "A" OF <br />ORDINANCE 0-02-00 RELATING TO <br />ESTABLISHMENT OF REVISED PARK <br />DEVELOPMENT IMPACT FEES TO FINANCE <br />PUBLIC PARK IMPROVEMENTS AND <br />FACILITIES <br />WHEREAS, on March 21, 2000, the City Council of the City of Colton adopted <br />several categories of development impact fees, including parkland dedication fees with <br />the adoption of Ordinance No. 0-02-00; and <br />WHEREAS, the City recently contracted with SCI Consulting Group to update <br />the City's parkland dedication requirements and park development impact fees in a <br />document titled "Park Impact Fee Nexus Study' ("Fee Study") dated March 2008; and <br />WHEREAS, except for the parkland dedication requirements and park <br />development impact fees amended by this Ordinance and subsequent fee resolutions, <br />all other development impact fees and fee categories adopted as part of Ordinance No. <br />0-02-00 remain unchanged; and <br />WHEREAS, the Fee Study complies with Government Code Section 66001 by <br />establishing the legal basis for the imposition of park fees, particularly: <br />ORANGE\RMOIN\46554.6 <br />1. Identifying the purpose of the revised fees (page 14 of Fee <br />Study); <br />2. Identifying the use to which the revised fee is to be put, <br />including identification of any facilities to be financed (page 14 of <br />Fee Study); <br />3. Determining how there is a reasonable relationship between <br />the fee's use and the type of development project on which the fee <br />is imposed (page 15 of Fee Study); <br />4. Determining how there is a reasonable relationship between <br />the need for the public facilities and the type of development <br />project upon which the fees are imposed (page 15 of Fee Study); <br />and <br />-1- <br />
