Determining how there is a reasonable relationship between <br />the amount of the fee and the cost of the public facilities or portion <br />or the public facility attributable to the development on which the <br />fee is imposed (page 15 of Fee Study); and <br />NOW, THEREFORE, the City Council of the City of Colton does ordain as <br />follows: <br />SECTION 1: Deletion of Section 4 of Ordinance No. 0-02-00. Section <br />4 of Ordinance No. 0-02-00 is hereby deleted in its entirety. <br />SECTION 2: Amendment to Section 11 of Ordinance No. 0-02-00. <br />Section 11 of Ordinance No. 0-02-00 is hereby amended in its entirety to read as <br />follows: <br />"SECTION 11: Adoption of Fees. The City Council hereby adopts the <br />development impact mitigation fees as set forth in Exhibit 'A." Each <br />owner of a residential lot or parcel shall pay such fees to the City prior to <br />the date of final inspection or the date the certificate of occupancy is <br />issued, whichever comes first, in accordance with Government Code <br />Section 66007, including subdivision (b) of that statute. Each owner of a <br />commercial or industrial lot or parcel shall pay park impact fees to the <br />City prior to the issuance of a building permit. Parkland dedication fees <br />shall be established by separate resolution of the City Council." <br />SECTION 3: Repealing Park Fees in Exhibit A of Ordinance 0-02-00. <br />The park development impact fees referenced in Exhibit "A" of Ordinance 0-02-00 are <br />hereby repealed in their entirety. <br />SECTION 4. CEQA Exemption. The adoption of this Ordinance is <br />exempt from the provisions of the California Environmental Quality Act (CEQA) <br />pursuant to State CEQA Guidelines sections 15061(b)(3), 15273 and 15301 because this <br />Ordinance merely amends a previous ordinance and makes findings for revised fees. <br />Thus, this action is categorically exempt and staff is directed to file a Notice of <br />Exemption with the San Bernardino County Clerk's office within five (5) working days <br />of approval. <br />SECTION 5: Effective Date. This Ordinance shall become effective <br />upon the effective date of a resolution establishing the revised park development <br />impact fees. <br />ORANGE\RMOIN\46554.6 <br />-2- <br />
