1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />221 <br />23 <br />24 <br />25 <br />26 <br />27' <br />28 <br />ORDINANCE NO. 0-10-08 <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF COLTON AMENDING COLTON <br />MUNICIPAL CODE SECTION 16.58.040(C) <br />RELATING TO STANDARDS FOR <br />DETERMINING DEDICATION TO CONFORM <br />TO 2000 CENSUS <br />WHEREAS, Article 11, Section 7 of the California Constitution authorizes the <br />City of Colton ("City") to enact measures that protect the health, safety and welfare of <br />its citizens; and <br />WHEREAS, the Quimby Act, Government Code Section 66477, authorizes a City <br />to require the dedication of land or impose a requirement of the payment of fees in lieu <br />thereof, or a combination of both, for park or recreational purposes as a condition to the <br />approval of a tentative map or parcel map; and <br />WHEREAS, according to the City's General Plan, the goal for acquisition and <br />development of parks for the City is 5.0 acres for every 1,000 residents; and <br />WHEREAS, the City has adopted the City of Colton Comprehensive Park and <br />Facilities Master Plan ("Master Plan") dated 2004, containing policies and standards for <br />parks and facilities and the park and recreational facilities are in accordance with <br />definite principles and standards; and <br />WHEREAS, in order to meet the goal of acquisition and development of parks, <br />the City collects Quimby Fees in addition to park development impact fees as permitted <br />by law; and <br />WHEREAS, it is fair and equitable for new development to pay its fair share and <br />contribute to financing, acquisition and initial development of new parks and the <br />rehabilitation of existing neighborhood or community parks and recreational facilities; <br />and <br />WHEREAS, for subdivided residential land, the City, under Section 16.58.010 of <br />the City Municipal Code and pursuant to the Quimby Act, receives dedication of land, <br />payment of fees in -lieu of land or a combination thereof at the current standard of 3.0 <br />acres per additional 1,000 residents; and <br />ORANGE\RMOIN\47598.6 <br />-1- <br />
