1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 221 23 24 25 26 27' 28 ORDINANCE NO. 0-10-08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING COLTON MUNICIPAL CODE SECTION 16.58.040(C) RELATING TO STANDARDS FOR DETERMINING DEDICATION TO CONFORM TO 2000 CENSUS WHEREAS, Article 11, Section 7 of the California Constitution authorizes the City of Colton ("City") to enact measures that protect the health, safety and welfare of its citizens; and WHEREAS, the Quimby Act, Government Code Section 66477, authorizes a City to require the dedication of land or impose a requirement of the payment of fees in lieu thereof, or a combination of both, for park or recreational purposes as a condition to the approval of a tentative map or parcel map; and WHEREAS, according to the City's General Plan, the goal for acquisition and development of parks for the City is 5.0 acres for every 1,000 residents; and WHEREAS, the City has adopted the City of Colton Comprehensive Park and Facilities Master Plan ("Master Plan") dated 2004, containing policies and standards for parks and facilities and the park and recreational facilities are in accordance with definite principles and standards; and WHEREAS, in order to meet the goal of acquisition and development of parks, the City collects Quimby Fees in addition to park development impact fees as permitted by law; and WHEREAS, it is fair and equitable for new development to pay its fair share and contribute to financing, acquisition and initial development of new parks and the rehabilitation of existing neighborhood or community parks and recreational facilities; and WHEREAS, for subdivided residential land, the City, under Section 16.58.010 of the City Municipal Code and pursuant to the Quimby Act, receives dedication of land, payment of fees in -lieu of land or a combination thereof at the current standard of 3.0 acres per additional 1,000 residents; and ORANGE\RMOIN\47598.6 -1-
