I opportunities is reasonably related to the impacts of the development on the City and <br />2 shall only be used for the purpose of developing new or rehabilitating existing <br />3 neighborhood or community park or recreational facilities. <br />M. To assure fair and legally sound implementation of Quimby land <br />4 <br />dedication and/or in -lieu fee requirements, such requirements may be reviewed <br />5 <br />annually and set by resolution following notice and hearing. <br />6 N. The findings contained in the Quimby Study are hereby adopted. The <br />7 Quimby Study is attached to this Ordinance as Exhibit "A." <br />8 SECTION 3: Amending Municipal Code Section 16.58.040(C). Section <br />9 16.58.040(C) of the Colton Municipal Code is hereby amended to read as follows: <br />10 "C. Dwelling Unit Occupancy Factor. The Dwelling Unit <br />Occupancy Factor for each type of dwelling unit shall be established by <br />11 resolution and based on the most recent available U.S. census data. These <br />12 figures may be revised from time to time by resolution." <br />13 SECTION 4: CEQA Exemption. The adoption of this Ordinance is <br />14 exempt from the provisions of the California Environmental Quality Act (CEQA) <br />15 pursuant to State CEQA Guidelines sections 15061(b)(3), 15273 and 15301 because this <br />16 Ordinance merely amends the Municipal Code to establish dwelling unit occupancy <br />17 factors by resolution. Thus, this action is categorically exempt and staff is directed to <br />18 file a Notice of Exemption with the San Bernardino County Clerk's office within five (5) <br />19 working days of approval. <br />20 SECTION 5: Effective Date.
