I available to the City, the City's existing park area is approximately 2.8 acres per 1,000 <br />2 residents. Therefore, the City's maximum dedication requirement and/or free allowed <br />3 under the Quimby Act is 3 acres of parkland for every 1,000 persons. <br />E. Under Municipal Code Section 16.58.040, the City's current park <br />4 <br />dedication requirement is based on a 3 acre per 1,000 population standard and the <br />5 following average number of persons (Dwelling Unit Occupancy Factor) per dwelling <br />6 unit type: <br />7 1. Multi -Family 2.2 persons <br />8 2. Planned Community Single Family 3.0 <br />9 3. Mobilehome 1.5 <br />10 4. Other Single Family 3.5 <br />11 F. Under Municipal Code Section 16.58.050, park in -lieu fees are determined <br />12 by multiplying the dedication requirement by the "fair market value of land being <br />13 developed plus the subdivision's fair share of contributions to cover the cost of park <br />14 improvements." <br />15 G. Based on recent residential vacant land sales, land value in the City is <br />16 estimated to be $253,000 per acre for the purposes of determining the Quimby in -lieu <br />fee. <br />17 <br />H. The amount and location of land to be dedicated or the in -lieu fees to the <br />18 <br />paid bear a reasonable relationship to the use of park and recreational facilities by the <br />19 future inhabitants of the subdivision because calculations are based on the population <br />20 of the City and parks are located in affected subdivisions. <br />21 I. The Quimby Study justifies the imposition of updated Dwelling Unit <br />22 Occupancy Factors because the data from the 2000 U.S. Census indicates increases in the <br />23 City population. <br />24 J. The purpose of the Quimby Fees is to mitigate the impact on City facilities <br />25 caused by increased demand for public park and recreational opportunities from <br />26 persons generated by development. <br />27 K. The Quimby in -lieu fees will be used to finance, acquire and assist in the <br />28 initial development of new parks and the rehabilitation of existing neighborhood or <br />community parks and recreational facilities. <br />L.
