2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-11-08 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON TO AMEND TITLE 18 OF THE COLTON <br />MUNICIPAL CODE TO INCLUDE NEW DEFINED TERMS <br />RELATED TO ASSEMBLY USES AND TO REQUIRE A <br />CONDITIONAL USE PERMIT FOR ASSEMBLY USES, <br />INCLUDING ENTERTAINMENT FACILITIES, BARS, <br />NIGHTCLUBS AND BANQUET HALLS <br />WHEREAS, on September 9, 2008 the Planning Commission of the City of <br />Colton ("Planning Commission") conducted a duly noticed public hearing and recommended the <br />City Council of the City of Colton ("City Council") amend various provisions of Title 18 of the <br />Colton Municipal Code (the "Municipal Code") to include definitions for various land uses, to <br />specify the zones in which certain uses currently not included in the Municipal Code may locate, <br />and to require a conditional use permit for "assembly uses", defined to include various uses <br />involving the assembly or gathering of persons including, but not limited to, entertainment <br />facilities, bars, nightclubs and banquet halls ("Zone Text Amendment"); <br />WHEREAS, the Planning Commission adopted a Resolution recommending <br />approval of the Zone Text Amendment to the City Council; and <br />WHEREAS, the City Council has determined that the Zone Text Amendment is <br />consistent with the City of Colton General Plan ("General Plan") as indicated below; and <br />WHEREAS, the City Council has determined that the proposed Zone Text <br />Amendment is in the best interests of the City, and that it would be in the public interest to <br />approve the Zone Text Amendment; <br />WHEREAS, the Application was reviewed, studied, and found exempt from the <br />California Environmental Quality Act ("CEQA") as more fully described below; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have <br />occurred. <br />WHEREAS, on October 7, 2008, the City Council held a duly noticed public <br />hearing at which all persons wishing to testify in connection with the Zone Text Amendment <br />were heard and the Zone Text Amendment was comprehensively reviewed. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />DOES ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth <br />above and in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. Section 18.04.057 is hereby added to Chapter 18.04 of Title 18 of <br />the Colton Municipal Code, to read as follows: <br />1118.04.057 Assembly use. <br />"Assembly use" means banquet hall, bar, entertainment facility, institution, <br />lodge or private club, meeting hall or place of assembly, nightclub, religious <br />assembly or place of worship, or other use involving the gathering or <br />assembly of people in a building or facility." <br />RVPUB\HSHANE\753177.1 <br />
