1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, following considerable discussion and public testimony regarding the <br />Project, the Planning Commission voted 4-3 to deny the Project and adopted Resolution Number <br />R-02-07; and <br />WHEREAS, a timely appeal of the Planning Commission's denial was received by <br />the City Clerk ("Appeal"); and <br />WHEREAS, on June 19, 2007 the City Council of the City ("City Council") <br />conducted a duly noticed public hearing on the Appeal at which time all persons wishing to <br />testify in connection with the Appeal were heard, and the Appeal was continued in order for the <br />Applicant to complete and submit a revised site plan for the Project to the City Council; and <br />WHEREAS, on August 15, 2007 the Applicant submitted a revised site plan and a <br />financial analysis of the expected benefits of the Project to the City; and <br />WHEREAS, on September 4, 2007 the Appeal was opened for public hearing at <br />which time all persons wishing to testify in connection with the Appeal were heard, and the City <br />Council considered the revised site plan and other information submitted by the Applicant; and <br />WHEREAS, the City Council continued the public hearing and directed staff to <br />complete an environmental assessment for the Project and to prepare additional conditions of <br />approval for the Project, including a requirement that the Applicant execute and record against the <br />Subject Site an Operating Agreement and Covenant to govern operation of the Project; and <br />WHEREAS, the Operating Agreement and Covenant, as per the new condition of <br />approval shall include, among other things, the following conditions: installation of additional <br />trees shall be required to screen views and reduce potential noise sources from the Subject Site; <br />equipment storage and storage of materials shall be required to be indoors or within the perimeter <br />wall of the Project; lifts or booms of heavy equipment that is stored outside shall be required to be <br />compressed and folded down so that the height of such equipment does not exceed the height of <br />RVPUB\HSHANE\733624.2 - 2 - <br />
