1 <br />2 <br />the perimeter wall; and maintenance of the site in a clean and attractive manner shall be required, <br />including sweeping of the entry driveways and street area adjacent to the site ("Operating <br />3 II Agreement") <br />4 <br />5 <br />6 <br />7 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, on September 18, 2007, the Appeal was opened for public hearing at <br />which time all persons wishing to testify in connection with the Appeal were heard, and <br />WHEREAS, the City Council determined that the Project, as revised and <br />conditioned, is consistent with the City's adopted General Plan and the requirements of the Colton <br />Municipal Code; and <br />WHEREAS, the Application was reviewed, studied, and found to comply with the <br />California Environmental Quality Act ("CEQA") as more fully described below; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />COLTON: <br />SECTION 1. The Recitals set forth above are true and correct and are <br />incorporated herein by reference. <br />SECTION 2. Based on the entire record before the City Council, all written and <br />oral evidence presented, and the findings made in this Resolution, the City Council hereby <br />overturns the decision of the Planning Commission denying the Application and approves the <br />Appeal for the reasons set forth below: <br />A. The City Council hereby finds that the proposed Application, as revised and <br />conditioned, is in accord with the General Plan of the City of Colton. The revisions to the site <br />plan and the Operating Agreement to be recorded against the Subject Site ensure that the Project <br />is an appropriate use and quality development, will operate in a positive manner, in accordance <br />with the objectives of the General Plan, and will not have a negative impact on surrounding <br />properties and land uses. <br />B. The City Council hereby finds that the Application, as revised and <br />conditioned, complies with the zoning regulations set forth in Title 18 of the City of Colton <br />Municipal Code (the "Zoning Code"). The revisions to the site plan and the Operating <br />Agreement to be recorded against the Subject Site ensure that the Project is an appropriate use <br />and quality development, that the Project will operate in a positive manner, in accordance with <br />RVPUB\HSHANE\733624.2 - 3 - <br />
