R-86-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON ORDERING THE ANNEXATION OF TERRITORY TO THE COLTON LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO.2 AND LEVYING ASSESSMENTS FOR FISCAL YEAR 2007/2008 WHEREAS, on June 19, 2007, the City Council (the "City Council") of the City of Colton adopted Resolution No. R-76-07, declaring its intention to annex certain territory to the Colton Landscape and Lighting Maintenance Assessment District No. 2 (the "Assessment District") and scheduling a public hearing thereon; and WHEREAS, by Resolution No. R-77-07, the City Council approved the report of MuniFinancial, the engineering firm employed by the City for the annexation proceedings (the "Report") which contained, among other matters, the proposed assessments to be levied for fiscal year 2007-08 upon assessable lots and parcels of property which comprise the Assessment District; and WHEREAS, pursuant to Section 53753 of the Government Code, by Resolution No. R-78-07, the City Council directed the City Clerk to mail notice of the proposed annexation and the proposed assessments and of the time and place of the public hearing thereon to the record owner of each parcel of property identified in the Report and further directed that each such mailed notice contain an assessment ballot upon which the property owner could indicate his or her support or opposition to the proposed assessments; and WHEREAS, the City Council has conducted the public hearing with respect to the annexation of the territory proposed to be annexed to the Assessment District and has received a report from the City Clerk regarding the tabulation of the assessment ballots submitted, and not withdrawn, in support of or opposition to the proposed assessments advising that the ballots which were received were voted in favor of the proposed
