Findings. The findings recited in the preceding paragraphs are true and correct. 2. Assessment District. The territory proposed to be annexed to the Assessment District as described in the Report shall be included in Zone 2 of the Colton Landscape and Lighting Maintenance Assessment District No. 2. The property which is proposed to be annexed to the Assessment District is all the property which is identified as Tract No. 17187. The boundaries of the territory proposed to be annexed to the Assessment District are further described and shown in the Report. The territory proposed to be annexed to the Assessment District is generally located along Johnston Avenue, just east of Rancho Avenue, in the City of Colton, County of San Bernardino. 3. Improvements. The Improvements which shall be provided for the property proposed to be annexed to the Assessment District by and through the assessments levied annually thereon shall include the following: (a) the installation or construction of public lighting, facilities, including, but not limited to, ornamental lighting; (b) the installation or planting of landscaping, including, but not limited to, turf, ground cover, shrubs, trees and entry monuments; (c) the installation or construction of any facilities which are appurtenant to any improvements listed in (a) and (b) or which are necessary or convenient for the maintenance or servicing thereof including, but not limited to, irrigation systems, drainage systems, and electrical facilities; and (d) the maintenance and servicing of any of the foregoing. 4. Annexation. The territory described in Section 2 hereof is hereby annexed to the Colton Landscape and Lighting Maintenance Assessment District No. 2. The diagram of the Assessment District, as modified to include the territory hereby proposed to be annexed to the Assessment District and as contained in the Report, is confirmed. 5. Lew of Assessments. The assessments proposed to be levied on the lots and parcels that are hereby annexed to the Assessment District in the amounts set forth in the Report and in the assessment ballot mailed to and returned by the owners of the property which is hereby annexed to the Assessment District shall be and are confirmed and levied for fiscal year 2007-08. 6. Duration of Assessments. The assessments which are to be levied on lots and parcels that are hereby annexed to the Assessment District shall be levied as long as the assessments are necessary to finance the cost of the operation, maintenance and servicing of the improvements described in Section 3 hereof within and for the Assessment District. The assessment amounts contained in the Report shall be subject to an annual adjustment or increase in an amount up to three percent (3%) provided the amount of the assessment to be levied on any parcel in any fiscal year shall not in any event exceed the actual total cost of
