R-105-08 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON SETTING A PUBLIC HEARING FOR THE <br />CONSIDERATION OF ITS INTENT TO VACATE <br />OWNERSHIP INTEREST IN STREETS WITHIN THE <br />RANCHO MEDITERRANIA MOBILEHOME ESTATES <br />DEVELOPMENT <br />WHEREAS, the City Council of the City of Colton ("City Council") desires to vacate its <br />ownership interest, if any, in certain street located within the Rancho Mediterrania Mobilehome <br />Estates in the City of Colton, County of San Bernardino, California, as more particularly <br />described in Exhibit "A" attached hereto ("Streets"); <br />WHEREAS, the Streets were never formally accepted as City streets, nevertheless, in <br />order to clear title and implement vacation, it is necessary to undertake a formal street vacation <br />process in accordance with California Streets & Highways Code, Section 8320 et. Seq.; and <br />WHEREAS, the streets are no longer needed for public street and highway purposes <br />within the City of Colton since they provide an internal circulation system for the Rancho <br />Mediterrania Mobilehome Estate lots and the streets are completely self-contained within the <br />Rancho Mediterrania Mobilehome Estates and do not provide any public access elsewhere in the <br />City; and <br />WHEREAS, the City Council does hereby declare its intent to vacate the Streets in <br />compliance with the public notice and public hearing provisions of the Public Streets, Highways, <br />and Service Easements Vacation Law of the Streets and Highway Code of the State of California <br />(Streets and Highways Code §8320 et. seq.) ("Vacation Law"); and <br />WHEREAS, the City Council intends to hold a duly noticed public hearing on October 7, <br />2008, to hear evidence offered on the proposed vacation of the Streets; and <br />ORANGE\MMARTINEZ\50052.1 <br />
