R-107-08 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, APPROVING AND AUTHORIZING THE CONVEYANCE OF THAT CERTAIN REAL PROPERTY LOCATED AT THE SOUTHEAST CORNER OF SOUTH COOLEY DRIVE AND EAST ASHLEY WAY TO THE REDEVELOPMENT AGENCY FOR THE CITY OF COLTON WHEREAS, the Redevelopment Agency for the City of Colton ("Agency") is a community redevelopment agency duly created, established, and authorized to transact business and exercise its powers, all under and pursuant to the California Community Redevelopment Law (Part 1 of Division 24, commencing with Section 33000 of the Health and Safety Code of the State of California) ("CRL"); and WHEREAS, the City of Colton ("City") adopted a redevelopment plan ("Redevelopment Plan") for the Cooley Ranch Redevelopment Project ("Project Area") on July 29, 1975, pursuant to the provisions of the CRL; and WHEREAS, the City is the owner of that certain real property located within the Project Area generally located at the southeast corner of South Cooley Drive and East Ashley Way and more fully described in Exhibit A attached to this Resolution ("Property"); and WHEREAS, California Government Code Section 37350 provides that the City may purchase, lease, receive, hold, and enjoy real and personal property, and control and dispose of it for the common benefit; and WHEREAS, Section 33220 of the CRL authorizes the City to dedicate, sell, convey or lease any of its property to a redevelopment agency, upon the terms and with or without consideration, as the City determines, for the purpose of aiding and co-operating in the planning, undertaking, construction, or operation of redevelopment projects located within the City; and WHEREAS, Section 33391 of the CRL authorizes the Agency to acquire real property for redevelopment purposes; and WHEREAS, the City desires to convey the Property to the Agency for redevelopment; and WHEREAS, the Agency desires to acquire the Property in order to facilitate the redevelopment of the Property pursuant to and in accordance with the Redevelopment Plan; and WHEREAS, the redevelopment of the Property is a public purpose and results in a common benefit to the citizens of the City by facilitating the redevelopment and revitalization of the Property which will contribute to the long-term economic development of the Project Area and the City.
