1 <br />2 <br />3 <br />4 <br />5 <br />6' <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13' <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />21 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, City staff has determined that the City's conveyance of the Property to <br />Agency is exempt from the requirements of the California Environmental Quality Act <br />("CEQA"), pursuant to State CEQA Guidelines Section 15061(b)(3), because it can be seen <br />with certainty that the mere transfer of title to the Property from the City to the Agency will <br />not have a significant effect on the environment; and <br />WHEREAS, pursuant to the foregoing, City staff has determined that a notice of <br />exemption ("Notice of Exemption") for the sale of the Property should be filed pursuant to <br />CEQA, the State CEQA Guidelines and the City's Local CEQA Guidelines. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Colton, California, as follows: <br />1. The City Council hereby determines that the conveyance of the Property to the <br />Agency will aid in the planning, undertaking, construction or operation of the Cooley Ranch <br />Redevelopment Project Area within the City; <br />2. The City Council hereby approves and authorizes the conveyance of the <br />Property to the Agency by and pursuant to the terms and conditions set forth in the Grant <br />Deed attached to this Resolution as Exhibit B and the Promissory Note attached to this <br />Resolution as Exhibit C. <br />3. The City Council hereby authorizes the City Manager to execute the Grant <br />Deed and to take such other actions and execute such other documents as may be necessary to <br />accomplish the City's conveyance of the Property to the Agency in accordance with this <br />Resolution. <br />4. The City Council hereby directs City staff to file a Notice of Exemption with <br />the Clerk of the Board of Supervisors of the County of San Bernardino, California, within five <br />(5) calendar days following the date of adoption of this Resolution. <br />5. The City Clerk shall certify to the passage and adoption of this Resolution. <br />6.
