R-109-08 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, APPROVING AND AUTHORIZING THE <br />PURCHASE OF REAL PROPERTY LOCATED SOUTH OF <br />CONGRESS STREET AND WEST OF THE SANTA ANA RIVER IN <br />THE CITY OF COLTON <br />WHEREAS, the City of Colton, California (the "City") is a municipal corporation <br />and a charter city duly created and existing pursuant to the Constitution and the laws of the <br />State of California; and <br />WHEREAS, California Government Code Section 37350 provides that the City may <br />purchase, lease, receive, hold, and enjoy real and personal property, and control and dispose <br />of it for the common benefit; and <br />WHEREAS, The Wildlands Conservancy ("Conservancy") is the owner of that <br />certain real property known as Assessors Parcel Numbers 0163-381-01 and 0163-381-02, <br />generally located south of Congress Street and west of the Santa Ana River in South Colton <br />and more fully described in Exhibit A attached to this Resolution ("Property"), and desires to <br />sell that approximately seventeen (17) acres to the City of Colton for the purposes of <br />protecting approximately six (6) acres of endangered Wooly Star habitat, and for potential <br />recreational, water recharge basins and/or other uses for five hundred thousand dollars <br />($soo,000); ana <br />WHEREAS, the City is a provider of domestic water to the citizens of Colton; and <br />WHEREAS, the City is working with the San Bernardino Valley Municipal Water <br />District, Riverside Public Utilities and the Western Water District to study the feasibility of <br />constructing a joint ground water recharge facility on property directly adjacent to the <br />j Conservancy property; and <br />
