1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12! <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, that certain real property is situated in proximity to the Santa Ana River <br />and other sources of water supply such as the State Water Project pipeline; and <br />WHEREAS, the acquisition of the Property would be for a public purpose and a <br />common benefit to the citizens of the City by providing a preferred site for the potential <br />creation of water recharge basins, a potential recreational park facility, and habitat <br />conservation for the endangered Wooly Star; and <br />WHEREAS, the City of Colton, the City of Riverside, and adjacent business owners <br />are in support of a land-use concept as herein described; and <br />WHEREAS, the City has commissioned a Phase I environmental report that shows <br />that the Property to be purchased by the City has no known significant environmental issues <br />that would prevent said property from being used for the uses as herein described, though it is <br />adjacent to property on which the old Guyaux landfill was located; and <br />WHEREAS, City staff has determined that the City's purchase of the Property does <br />not constitute a project under the California Environmental Quality Act ("CEQA") because it <br />will not result in a direct or indirect physical change in the environment. This purchase is <br />exempt from CEQA under Section 15061(b)(3) of the State CEQA Guidelines because it can <br />be seen with certainty that there is no possibility that a transfer in ownership may have a <br />significant effect on the environment and under Section 15004(b)(2)(A) of the State CEQA <br />Guidelines because the purchase of the property is being accomplished through land <br />acquisition agreements and the City will complete any necessary CEQA review before <br />� developing or using the property; and <br />
