R-128-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR THE VETERANS PARK SPORTS COMPLEX PROJECT (DAP -000-525) WHEREAS, the Veterans Park Sports Complex Project — File Index Number DAP -000- 525 (the "Project") -- is part of the City's Fiscal Year 2008/2009 Capital Improvement Program; and WHEREAS, an Initial Study was prepared for the Project pursuant to the California Environmental Quality Act ("CEQA") (California Public Resources Code §§ 21000-21177) and the City's local guidelines for implementing CEQA; and WHEREAS, the Initial Study concluded that the Project will not have a significant effect on the environment with the incorporation of mitigation measures in the areas of air quality, biological resources, geology and soils, and noise; and WHEREAS, the Initial Study indicates that all potentially significant adverse environmental impacts that may result from the activities contemplated under the Project can be mitigated to a level of insignificance, with the adoption of the mitigation measures included in the MND; and WHEREAS, copies of the Initial Study and the MND were released for a public review period; and WHEREAS, on August 26, 2008, the Planning Commission conducted a properly noticed and published public hearing on the matter, provided an opportunity for all interested parties to be heard, conditionally approved the Project, approved the MND and directed staff to file a Notice of Determination with the County of San Bernardino Clerk of the Board of Supervisors; and WHEREAS, because the City Council has the final decision making authority over the Project, the City Council must also approve the MND for the Project.
