R-128-08 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON ADOPTING THE <br />MITIGATED NEGATIVE DECLARATION FOR THE VETERANS PARK SPORTS COMPLEX <br />PROJECT (DAP -000-525) <br />WHEREAS, the Veterans Park Sports Complex Project — File Index Number DAP -000- <br />525 (the "Project") -- is part of the City's Fiscal Year 2008/2009 Capital Improvement Program; <br />and <br />WHEREAS, an Initial Study was prepared for the Project pursuant to the California <br />Environmental Quality Act ("CEQA") (California Public Resources Code §§ 21000-21177) and <br />the City's local guidelines for implementing CEQA; and <br />WHEREAS, the Initial Study concluded that the Project will not have a significant <br />effect on the environment with the incorporation of mitigation measures in the areas of air <br />quality, biological resources, geology and soils, and noise; and <br />WHEREAS, the Initial Study indicates that all potentially significant adverse <br />environmental impacts that may result from the activities contemplated under the Project can <br />be mitigated to a level of insignificance, with the adoption of the mitigation measures included <br />in the MND; and <br />WHEREAS, copies of the Initial Study and the MND were released for a public review <br />period; and <br />WHEREAS, on August 26, 2008, the Planning Commission conducted a properly noticed <br />and published public hearing on the matter, provided an opportunity for all interested parties to <br />be heard, conditionally approved the Project, approved the MND and directed staff to file a <br />Notice of Determination with the County of San Bernardino Clerk of the Board of Supervisors; <br />and <br />WHEREAS, because the City Council has the final decision making authority over the <br />Project, the City Council must also approve the MND for the Project. <br />ONTARIO\N STU BBS\300204.1 <br />1 <br />
