R-58-08 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON DENYING THE APPEAL OF THE <br />PLANNING COMMISSION'S DECISION REGARDING <br />THE AGUA MANSA COMMERCE CENTER PROJECT, <br />CERTIFYING THE FINAL ENVIRONMENTAL IMPACT <br />REPORT PREPARED FOR THE AGUA MANSA <br />COMMERCE CENTER PROJECT AND ADOPTING <br />ENVIRONMENTAL FINDINGS PURSUANT TO THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT, A <br />STATEMENT OF OVERRIDING CONSIDERATIONS, A <br />MITIGATION MONITORING AND REPORTING <br />PROGRAM, ADOPTING TENTATIVE MAP FINDINGS <br />AND APPROVING THE PROJECT. <br />WHEREAS, the Agua Mansa Commerce Center Project ("Project") consists <br />of Design Review (DAP 000-662) and Tentative Tract Map (TTM 18250) for subdivision <br />and development of eleven (11) concrete tilt-up or steel building(s) totaling 1,365,400 square <br />feet of floor area, a truck/trailer parking lot, and a detention basin, on approximately 94.18 <br />acres. The Project would be developed in two phases. Buildings 7 through 11 would be <br />developed in Phase I and Buildings 1 through 6 would be developed in Phase II. The Project <br />applicant is AMB Property Corporation; and <br />WHEREAS, the Project area is located on property in the City of Colton in <br />San Bernardino County, California, also known as Assessor Parcel Map Numbers 0260- <br />09177, 78, and 82 ("Project site"); and <br />WHEREAS, pursuant to the California Environmental Quality Act ("CEQA") <br />(Pub. Res. Code, § 21000 et seq.) and the State CEQA Guidelines (Cal. Code Regs., tit. 14, § <br />15000 et seq.), the City of Colton (the "City") is the lead agency for the Project; and <br />WHEREAS, the City, as lead agency, determined that an Environmental <br />Impact Report (`BIR") should be prepared pursuant to CEQA to analyze all potential adverse <br />environmental impacts of the Project; and <br />WHEREAS, the City issued a Notice of Preparation ("NOP") of a Draft EIR <br />on or about July 6, 2007, and circulated the NOP for a period of 30 days, pursuant to State <br />CEQA Guidelines sections 15082(a), 15103 and 15375; and <br />
