Staff, the <br />applicant and environmental consultants held subsequent meetings with both the City of <br />Riverside and the City of Rialto; and <br />WHEREAS, during these meetings, staff was able to address the concerns <br />raised by the City of Riverside and the City of Riverside no longer opposes the Project; and <br />WHEREAS, on May 13, 2008, the Planning Commission by a vote of 5 <br />members in favor, 2 absent from the meeting, adopted Resolution Number R-03-08, certifying <br />the Final Environmental Impact Report, adopting Environmental Findings pursuant to CEQA, <br />a Statement of Overriding Considerations, a Mitigation Monitoring and Reporting Program, <br />and Approving the Agua Mansa Commerce Center Project; and <br />WHEREAS, on May 21, 2008, the City of Rialto appealed the Planning <br />Commission's approval of the Project (the, "Appeal"); and <br />WHEREAS, on June 17, 2008, the City Council convened at a noticed public <br />hearing to consider the Appeal and to independently review and consider the environmental <br />impacts of the Project at which time all persons wishing to testify in connection with the <br />Appeal and the Project were heard, and the Appeal and Project were comprehensively <br />reviewed and considered; and <br />WHEREAS, pursuant to Public Resources Code section 21092.5, the City <br />provided written responses to comments to all commenting agencies within the statutory time <br />frame; and <br />WHEREAS, the City prepared the Final EIR and, pursuant to Public <br />Resources Code section 21092.5, the City provided copies of the Final EIR to all commenting <br />agencies; and <br />WHEREAS, as contained herein, the City has endeavored in good faith to set <br />forth the basis for its decision on the Project; and <br />WAEREAS, all the requirements of CEQA and the State CEQA Guidelines <br />have been satisfied by the City in the Final EIR, which is sufficiently detailed so that all of the <br />3 <br />
