R-73-08 <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF COLTON APPROVING A PARK <br />DEVELOPMENT IMPACT FEE (NEXUS) <br />STUDY; AND ESTABLISHING REVISED PARK <br />DEVELOPMENT IMPACT FEES TO FINANCE <br />PUBLIC IMPROVEMENTS AND FACILITIES <br />WHEREAS, the continuing growth of the City of Colton ("City"), the <br />expectation of high quality City services by people who live or work in the City <br />and limited state funding to local governments have created a need for the <br />review of the City's existing and future public facilities made necessary by new <br />development; and <br />WHEREAS, Article 11, Section 7 of the California Constitution authorizes <br />the City to enact measures that protect the health, safety and welfare of its <br />citizens; and <br />WHEREAS, Government Code Sections 66000 et seq. empower the City to <br />impose fees and other exactions to provide necessary public facilities required to <br />'I mitigate the negative effects of new development projects; and <br />WHEREAS, it is fair and equitable for new development to pay its fair <br />I share and contribute to financing, acquisition, and establishment of such facilities <br />to enable the City to provide necessary public services to new residents, <br />businesses and their employees; and <br />WHEREAS, it is also fair and equitable for certain land uses, such as <br />� residential, to pay higher development impact fees than other land uses given <br />their land use intensity and the burden they create on the City's infrastructure; <br />and <br />WHEREAS, a process for deferral or reduction of fees will allow for better <br />�� or fairer financing arrangements and ensure fees are fairly imposed according to <br />impact created and benefit received; and <br />WHEREAS, a phasing of increased fees over time will allow for new <br />development to adjust to new fee increases; and <br />\lOpy07!.DOC <br />-1- <br />
