11 <br />21 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />221 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the findings set out below are based on a document prepared <br />by SCI Consulting Group and entitled "Park Impact Fee Nexus Study" ("Fee <br />Study"), dated March 2008; and <br />WHEREAS, the Fee Study complies with Government Code Section 66001 <br />by establishing the legal basis for the imposition of park fees, particularly: <br />1. Identifying the purpose of the revised fees (page 14 of Fee <br />Study); <br />2. Identifying the use to which the revised fee is to be <br />put, including identification of any facilities to be financed <br />(page 14 of Fee Study); <br />3. Determining how there is a reasonable relationship <br />between the fee's use and the type of development project <br />on which the fee is imposed (page 15 of Fee Study); <br />4. Determining how there is a reasonable relationship <br />between the need for the public facilities and the type of <br />development project upon which the fees are imposed (page <br />15 of Fee Study); and <br />5. Determining how there is a reasonable relationship <br />between the amount of the fee and the cost of the public <br />facilities or portion or the public facility attributable to the <br />development on which the fee is imposed (page 15 of Fee <br />Study); and <br />4VHEREAS, both the Recreation & Parks and Planning Commissions for <br />the City have recommended the City adopt the Fee Study; and <br />WHEREAS, detailed descriptions of each of the facilities, their <br />approximate location, size, time of availability and their estimated costs are set <br />forth in a document prepared by Richard Fisher Associates and entitled "City of <br />Colton Comprehensive Park and Facilities Master Plari' ("Master Plan") dated <br />� Apri12004; and <br />I \lOpy07!.DOC <br />-2- <br />
