Each <br />owner of a commercial or industrial lot or parcel shall pay to the City, prior to <br />the issuance of a building permit, the fees set forth in the Fee Study. Each owner <br />of a residential lot or parcel shall pay such fees to the City prior to the date of <br />final inspection or the date the certificate of occupancy is issued, whichever <br />comes first, in accordance with Government Code Section 66007, including <br />subdivision (b) of that statute. In accordance with subdivision (b) of Section <br />66007, at such time as the City establishes an account, appropriates funds and <br />establishes a construction schedule or plan for the use of the fees, the City <br />Council hereby authorizes collection of the residential park development impact <br />fees prior to the issuance of a building permit. <br />SECTION 4: Adoption of Deferral or Reduction Process. The <br />City Council is hereby empowered to grant a deferral or reduction of any fee <br />imposed by this Resolution upon written request. Such deferral or reduction <br />may only be granted after notice and hearing before the City Council based on <br />written and other evidence submitted by the property owner. Findings for a <br />deferral must include all of the following: (1) deferral would allow a better or <br />fairer financing arrangement; (2) the review of and delay in fee imposition will <br />not burden other properties to be benefited by any fee; and (3) alternative <br />financing methods for the public facility have been proposed. Findings for a <br />reduction must include all of the following: (1) the owner will receive <br />insufficient or no benefit from the fee imposed and (2) imposing the full fee(s) <br />would require the owner to pay more than his or her fair share for the benefit <br />I received. <br />SECTION 5: CEQA Exemption.
