1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, for subdivided residential land, the City, under Section <br />16.58.010 of the City Municipal Code and pursuant to the Quimby Act, receives <br />dedication of land, payment of fees in -lieu of land or a combination thereof at the <br />current standard of 3.0 acres per additional 1,000 residents; and <br />WHEREAS, the City's calculation standard for determining land <br />dedication includes a Dwelling Unit Occupancy Factor (i.e. the average number <br />of people in a particular type of housing) based upon census data and Section <br />16.58.040 of the Municipal Code allows these figures to be revised from time to <br />time by resolution; and <br />WHEREAS, SCI Consulting Group has conducted a study for the City <br />entitled "City of Colton Quimby Dedication Requirement and In -Lieu Fee Study" <br />("Quimby Study"), dated March 2008; and <br />WHEREAS, the Quimby Study indicates that population of the City has <br />grown in numbers since the codification of Section 16.58.040 and requires that <br />the Dwelling Unit Occupancy Factors be updated to reflect the growth as <br />indicated in the 2000 census data; and <br />WHEREAS, the Quimby Study recommends that park dedication <br />requirement and in -lieu fees be expressed on a per unit basis for all housing <br />types because the need and demand for park and recreational services is <br />inherently driven by population and different land uses have varying household <br />sizes; and <br />WHEREAS, both the Recreation & Parks and Planning Commissions for <br />the City have recommended the City adopt the Quimby Study and its findings; <br />land <br />WHEREAS, copies of the Quimby Study and the Master Plan are on file <br />in the City Clerk's office and have been made available for public review; and <br />WHEREAS, the City Council has carefully reviewed and considered the <br />staff report, the Quimby Study, the Master Plan and all oral and written <br />presentations; <br />J ORANGE\MMARTINEZ\49200.2 <br />-2- <br />
