The City Council <br />hereby approves the "City of Colton Quimby Dedication Requirement and In - <br />Lieu Fee Study" conducted by SCI Consulting Group and dated March 2008. <br />The Quimby Study is attached to this Resolution and incorporated herein as <br />Exhibit "A." <br />SECTION 2: Adoption of Revised Quimby Fees. The City <br />Council of the City of Colton hereby adopts revised Qimby Fees as set forth in <br />the attached Exhibit "B." Such fees shall be paid prior to final map approval for <br />any subdivision map and in accordance with the requirements of the Colton <br />Municipal Code and California Government Code, Section 66477. <br />SECTION 3: Adoption of Dwelling Unit Occupancy Factors. <br />Revised Dwelling Unit Occupancy Factors based on the 2000 U.S. Census data <br />are established as set forth in the Quimby Study. <br />SECTION 4: Adoption of Fair Market Land Values. Fair Market <br />Land Values used in calculating Quimby in -lieu fees are established as set forth <br />in the Quimby Study. Notwithstanding the adoption of these Fair Market Land <br />Values, if a subdivider objects to the valuation contained in the Quimby Study, <br />the subdivider may, at their expense, obtain an appraisal of the park area <br />property by a qualified real estate appraiser approved by the City, which <br />appraisal may be accepted by the City Council if found reasonable, or the City <br />Council and the subdivider may agree as to the fair market land value. <br />SECTION 5: CEQA Exemption. The adoption of this Resolution is <br />exempt from the provisions of the California Environmental Quality Act (CEQA) <br />pursuant to State CEQA Guidelines sections 15061(b)(3), 15273 and 15301 <br />because this Resolution merely update the costs to renovate and improve <br />existing parks Park Facilities needed to support new development in the City. <br />Thus, this action is categorically exempt and staff is directed to file a Notice of <br />Exemption with the San Bernardino County Clerk's office within five (5) working <br />days of approval. <br />ORANGE\MMARTINEZ\49200.2 <br />-3- <br />
