2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 WHEREAS, the FREIR, including a Mitigation Monitoring and Reporting Program (MMRP) HM -2, was adopted and certified by the Planning Commission on June 13, 2006, and adopted and approved by the City Council of the City of Colton ("City Council") on July 18, 2006 pursuant to the adoption of Resolution No. R-84-06; and WHEREAS, the adopted FREIR MMRP HM -2 provides further details and specifications regarding the Approved Processes; and WHEREAS, the Applicant now desires to treat and manage the shredder fluff as a recyclable material, which process would provide for removal of 100% of the shredded recyclable material off-site; and WHEREAS, the proposed management of the shredder fluff as a recyclable material would allow for removal of the material from the Site on a daily basis instead of a two to three week basis, which would be more expedient for the Applicant and the City; and WHEREAS, management of the shredder fluff as a recyclable material will allow for a reduction of approximately 35 truck trips to and from the Site per month and will also likely reduce the storage of shredder fluff on the Site; and WHEREAS, on July 22, 2008, the Planning Commission conducted a duly noticed public hearing on the Application for the Modification at which time all persons wishing to testify in connection with the proposed Modification were heard, and the Application for the Modification was comprehensively reviewed; and WHEREAS, the Planning Commission found that the Application is consistent with the General Plan of the City, and that the proposed Modification does not change any of the Planning Commission's prior findings and determinations that the Facility is consistent with the intent and guidelines of the General Plan; and WHEREAS, the Planning Commission found that the Application, including all conditions attached thereto, is consistent with each of the applicable provisions of Chapter 18 of the City of Colton Municipal Code (the "Zoning Code"), and that the Modification does not affect the Planning Commission's prior determination and findings regarding zoning consistency of the Facility; and WHEREAS, the Planning Commission reviewed the Application and determined that the Modification will not result in any new significant environmental impacts, and that the Project has been ftilly analyzed in the previously certified FREIR; and WHEREAS, the Planning Commission determined that none of the circumstances set forth in State California Environmental Quality Act (CEQA) Guidelines section 15162 have occurred and that, therefore, no additional environmental review is required for approval of the Application; and WHEREAS, a timely appeal of the approval of the Application was received by the City Clerk (the "Appeal"); and -2-
