2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />WHEREAS, the FREIR, including a Mitigation Monitoring and Reporting <br />Program (MMRP) HM -2, was adopted and certified by the Planning Commission on June 13, <br />2006, and adopted and approved by the City Council of the City of Colton ("City Council") on <br />July 18, 2006 pursuant to the adoption of Resolution No. R-84-06; and <br />WHEREAS, the adopted FREIR MMRP HM -2 provides further details and <br />specifications regarding the Approved Processes; and <br />WHEREAS, the Applicant now desires to treat and manage the shredder fluff as a <br />recyclable material, which process would provide for removal of 100% of the shredded recyclable <br />material off-site; and <br />WHEREAS, the proposed management of the shredder fluff as a recyclable <br />material would allow for removal of the material from the Site on a daily basis instead of a two to <br />three week basis, which would be more expedient for the Applicant and the City; and <br />WHEREAS, management of the shredder fluff as a recyclable material will allow <br />for a reduction of approximately 35 truck trips to and from the Site per month and will also likely <br />reduce the storage of shredder fluff on the Site; and <br />WHEREAS, on July 22, 2008, the Planning Commission conducted a duly <br />noticed public hearing on the Application for the Modification at which time all persons wishing <br />to testify in connection with the proposed Modification were heard, and the Application for the <br />Modification was comprehensively reviewed; and <br />WHEREAS, the Planning Commission found that the Application is consistent <br />with the General Plan of the City, and that the proposed Modification does not change any of the <br />Planning Commission's prior findings and determinations that the Facility is consistent with the <br />intent and guidelines of the General Plan; and <br />WHEREAS, the Planning Commission found that the Application, including all <br />conditions attached thereto, is consistent with each of the applicable provisions of Chapter 18 of <br />the City of Colton Municipal Code (the "Zoning Code"), and that the Modification does not affect <br />the Planning Commission's prior determination and findings regarding zoning consistency of the <br />Facility; and <br />WHEREAS, the Planning Commission reviewed the Application and determined <br />that the Modification will not result in any new significant environmental impacts, and that the <br />Project has been ftilly analyzed in the previously certified FREIR; and <br />WHEREAS, the Planning Commission determined that none of the circumstances <br />set forth in State California Environmental Quality Act (CEQA) Guidelines section 15162 have <br />occurred and that, therefore, no additional environmental review is required for approval of the <br />Application; and <br />WHEREAS, a timely appeal of the approval of the Application was received by <br />the City Clerk (the "Appeal"); and <br />-2- <br />
