The Planning Commission previously found (see Planning Commission Resolution <br />No. R-05-06) that the Facility supports the intent of the M-2 zone, which is intended to provide <br />for the establishment of industrial uses essential to the development. In approving the <br />Application, the Planning Commission found that the Modification would not change its previous <br />finding. The City Council concurs, and finds that by providing for more efficient operation of the <br />Facility, the Modification promotes the continued operation of industrial uses in the M-2 zone in <br />accordance with the intent of that zone. <br />B. The Planning Commission previously found (see Planning Commission Resolution <br />No. R-05-06) that the Facility is compatible with other uses permitted in the M-2 zone, and that <br />the emission of odor, dust, fumes, gas, noise, vibration and other similar undesirable <br />characteristics will not be detrimental to any abutting zone or the community as a whole. In <br />approving the Application, the Planning Commission found that the Modification would not <br />change its previous finding. The City Council concurs, and finds that the Modification is <br />anticipated to result in less track traffic to and from the Site, and less storage of shredder fluff at <br />the Site, which will further reduce any impacts of the Facility. <br />SECTION 4. Finding that Application is Not Detrimental to Public Health, Safet <br />or Welfare. Based on the entire record before the City Council and all written and oral evidence <br />presented and/or on file with the City, including but not limited to the City Council Agenda <br />Report accompanying this item, the Planning Commission staff report dated July 22, 2008, the <br />findings made in this Resolution and by the Planning Commission in Resolution No. R-04-08, the <br />FREIR and the comments and responses thereto, the Revised FEIR, the Revised Draft EIR, the <br />Draft EIR, City Council Resolutions No. R-84-06 and R-85-06, Planning Commission Resolution <br />No. R-05-06, the Planning Commission Agenda Report dated August 24, 2004 pertaining to the <br />Facility, and the Planning Commission Agenda Report dated June 13, 2006 pertaining to the <br />Facility, the City Council finds that the proposed Modification together with the conditions <br />applicable thereto, will not be detrimental to the public health, safety or welfare, or materially <br />injurious to properties or improvements in the vicinity of the Site. The proposed Modification <br />clarifies that the Applicant is authorized to utilize any of the Approved Processes for the <br />treatment of shredder fluff. <br />The proposed Modification does not change the City Council's previous findings <br />that the Facility is (1) consistent with the general plan and land use designations for this area; and <br />(2) compatible with surrounding uses with the implementation of all previously adopted <br />mitigation measures. Further, the Modification is anticipated to reduce truck trips to and from the <br />Site, and to reduce the amount of and time that shredder fluff is stored at the Site. The proposed <br />Modification is in accordance with the approved FREIR, and the FREIR shows that the <br />Modification will not have a significant effect on the environment. Therefore, approval of the <br />Application will not be detrimental to the public health, safety or welfare, or materially injurious <br />to properties or improvements in the vicinity of the Site. <br />WON <br />
