Noise Element - General Objective & Principle No. 2 (pp. 5-7). "To <br />achieve and maintain an environment where noise is compatible with human <br />activities interacting with a variety of land uses.1 Control noise exposure from <br />future noise generators so the ambient environment will be kept within acceptable <br />limits. " Approval of the Application will not impact noise sources. Conformance <br />with mitigation measures previously imposed on the Facility will mitigate noise <br />impacts to less than significant levels in compliance with City noise standards <br />(See August 24, 2004, Planning Commission Agenda Report at pp. 6-7; see also <br />Section 5.3 of the Revised Final EIR and Responses to Comments Re Noise <br />Issues.) and the Modification is anticipated to result in a reduction of certain noise <br />sources related to operation of the Facility. <br />a. Approval of the Modification is anticipated to result in a reduction of <br />approximately 35 truck trips to and from the Site per month, thereby <br />reducing any truck noise related to operation of the Site. <br />b. Approval of the Modification will not result in any additional noise <br />impacts, further, note that the Court upheld the 2004 EIR with regard to its <br />analysis of noise impacts. <br />4. Model Air Quality Element- Topic 2: Ground Transportation, Policy 2.1.1 <br />"Eliminate Vehicle Trips" (pp 4) "Use incentives, regulations and Transportation <br />Demand Management in cooperation with other jurisdictions in the South Coast <br />Air Basin to eliminate vehicle trips which would otherwise be made. " <br />a. Approval of the Modification is anticipated to result in the elimination of <br />approximately 35 vehicle trips which would otherwise have been made to <br />and from the project site. <br />5. Finally, the City Council previously found (see City Council Resolution <br />No. R-84-05) that operation of the Facility will not directly conflict with any <br />goals, policies and objectives that are fundamental, mandatory and unambiguous. <br />The City Council finds that the proposed Modification will not change this prior <br />finding. <br />SECTION 3. Zoning Consistency of Applicatio . Based on the entire record <br />before the City Council and all written and oral evidence presented and/or on file with the City, <br />including but not limited to the City Council Agenda Report accompanying this item, the <br />Planning Commission staff report dated July 22, 2008, the findings made in this Resolution and <br />by the Planning Commission in Resolution No. R-04-08, the FREIR and the comments and <br />responses thereto, the Revised FEIR, the Revised Draft EIR, the Draft EIR, City Council <br />Resolutions No. R-84-06 and R-85-06, Planning Commission Resolution No. R-05-06, the <br />Planning Commission Agenda Report dated August 24, 2004 pertaining to the Facility, and the <br />Planning Commission Agenda Report dated June 13, 2006 pertaining to the Facility, the City <br />Council finds that the proposed Modification complies with each of the applicable provisions of <br />Title 18 of the Colton Municipal Code. <br />-5- <br />
