The Recitals set forth above are true and correct and are incorporated herein by reference. SECTION 2. Approval of Modified Conditional Use Permits. Based on the entire record before the City Council, all written and oral evidence presented, and the findings made in this Resolution, the City Council hereby modifies the decision of the Planning Commission and modifies the Applications, subject to all prior conditions of approval and the Amended and Restated Conditions of Approval which are attached to this Resolution as Exhibit "A" and incorporated herein and made a part of this Resolution. This modification is to permit the operation of a banquet facility with ancillary alcohol sales and dancing on the Subject Site, subject to the Amended and Restated Conditions of Approval, attached to this Resolution as Exhibit "A". This approval is granted based upon the approved Site Plan submitted as part of DC -51-00, on file with the Colton Community Development Department, except as modified by this approval. Deviations from said Site Plan shall not be permitted without the approval of the Colton Planning Commission. In the event that conditions reflected on the Site Plan are inconsistent with the Amended and Restated Conditions of Approval attached hereto as Exhibit "A", the written conditions shall prevail. SECTION 3. Conditional Use Permit (Modification)Findings. The City Council hereby finds as follows with respect to the modification of the Applications: 1. The proposed modification to the use is in accord with the general plan, the objectives of Title 18 of the Colton Municipal Code, and the purposes of the zone in which the Subject Site is located. The proposed modified use is located in an area zoned C-2 (General Commercial). The Subject Site is designated as "General Commercial" in the Colton General Plan. It is located within the C-2 (General Commercial) zoning designation. Modification of the Applications to permit use of the Subject Site as banquet facility with ancillary liquor sales for on-site consumption and dancing permitted via a regulated dance permit are conditionally permitted uses in this zoning designation. This modified conditional use permit has also been conditioned to comply with all applicable requirements of Title 18 of the Colton Municipal Code. 2.
