These conditions include, but are not limited to: on-site security <br />guard requirements, graffiti removal, emergency access, landscaping requirements, alcohol sales <br />restrictions, occupancy restrictions, and limited hours of operation. <br />3. The proposed modification to the use complies with each of the <br />applicable provisions of Title 18 of the Colton Municipal Code. <br />The Subject Site is designated as "General Commercial" in the Colton General <br />Plan. It is located within the C-2 (General Commercial) zoning designation. Modification of the <br />Applications to permit use of the Subject Site as banquet facility with ancillary liquor sales for <br />on-site consumption and dancing permitted via a regulated dance permit are conditionally <br />permitted uses in this zoning designation. This modified conditional use permit has also been <br />conditioned to comply with all applicable requirements of Title 18 of the Colton Municipal Code <br />SECTION 4. Approval of Dance Permit. The City Council hereby directs <br />the Chief of Police to approve the December 2007 application for a dance permit <br />submitted by Robert Hernandez, one of the operators of El Sombrero, to allow dancing <br />at the Subject Site. The dance permit shall be subject to the Amended and Restated <br />Conditions of Approval in Exhibit "A" of this Resolution. In addition, the permittee <br />shall comply with all requirements of Colton Municipal Code section 5.32, and any <br />dance permit conditions as determined by the Colton Police Department. <br />SECTION 5. CEOA Findings. This modification has been deemed to be <br />categorically exempt from the requirements of the California Environmental Quality Act <br />(CEQA) pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines.
