R-54-10 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />IMPOSING CERTAIN FINE AND PENALTY AMOUNTS FOR <br />ADMINISTRATIVE CITATIONS ISSUED FOR VIOLATIONS OF THE <br />GRAFFITI ORDINANCE OF THE COLTON MUNICIPAL CODE <br />WHEREAS, the City of Colton (the "City") finds that the enforcement of the Colton <br />Municipal Code and applicable State codes throughout the City is an important public service; <br />and <br />WHEREAS, enforcement of the Colton Municipal Code is vital to the protection of the <br />public's health, safety and quality of life; and <br />WHEREAS, California Government Code section 53069.4 authorizes the City Council to <br />establish administrative fines and penalties for violations of the Colton Municipal Code; and <br />WHEREAS, Section 8.12.010 of the Colton Municipal Code provides that every violation <br />of the Municipal Code that is an infraction or misdemeanor shall be subject to an administrative <br />fine and penalty; and <br />WHEREAS, Section 8.12.040 of the Colton Municipal Code authorizes the City Council <br />to establish by resolution the amounts of administrative fines for violations of the Colton <br />Municipal Code; and <br />WHEREAS, the City recognizes it is important to provide appropriate incentives for <br />citizens to comply with the City's graffiti regulations, as contained in Chapter 9.27 of the Colton <br />Municipal Code, for the health and safety of Colton residents and the protection of property, and <br />WHEREAS, the City Council desires to specifically impose administrative fines and <br />penalties for graffiti violations to provide greater incentives for compliance; and <br />WHEREAS, State law does not place express limits on the amount of administrative fines <br />and penalties that may be imposed by cities for violations that can otherwise be prosecuted as <br />misdemeanors. <br />-1- <br />
