one percent (1 %) of the Total Bid, and the portion of the work which will be done by each <br />Subcontractor. Only one Subcontractor may be listed for each portion of the work. <br />If the Contractor fails to specify a Subcontractor for any portion of the work in excess of <br />one-half (1/2) of one percent (]%) of the Total Bid to be performed under the Contract, he <br />shall be deemed to have agreed to perform such portion himself and he shall not be <br />permitted to subcontract that portion ofthe work except under conditions permitted by law. <br />Subletting or subcontracting of any portion of the work as to which no subcontractor was <br />designated in the original Bid(s) shall only be permitted in case of public emergency or <br />necessity, or otherwise permitted by law, and then only after a finding reduced to writing <br />as a public record of the City. <br />A. The intent of this Agreement is to secure contractors, which shall provide TREE <br />TRIMMING MAINTENANCE AND ELECTRIC UTILITY LINE CLERANCE <br />TREE TRIMMING SERVICES. <br />B. Contractors shall furnish all labor, tools, materials, and equipment to provide landscape <br />maintenance services as set forth in this Agreement. <br />C. All work shall be done in a thorough and workmanlike manner to the satisfaction of the <br />utility Director, or his authorized agent, and comply with all legal construction and <br />landscape maintenance practices. The premises shall be maintained at the level of service <br />provided for in these specifications at all times. <br />D. Contractors shall be available Monday through Sunday, 6:00 a.m. to 5:00 p.m. to respond <br />to any calls regarding maintenance of assigned areas. <br />E. Contractors shall perform a daily maintenance inspection, during daylight hours, of all <br />areas. Such inspection shall be both visual and operational. It shall include, but not be <br />limited to, the operation of all irrigation and/or other mechanical systems to check for <br />proper condition and reliability. <br />AREAS TO BE MAINTAINED <br />This is a city-wide tree trimming service. City will provide electric circuit maps to Contractor for <br />electric utility line clearance service areas. <br />BID REQUIREMENTS <br />A. Prior to the awards of the contract, any bidder may be required to document and provide <br />references to the Utility Director to illustrate that he can successfully perform maintenance <br />work involved in this contract, and that he possesses suitable equipment to perform the <br />work in a timely manner. <br />AGREEMENT <br />19 <br />(BB&K: 1-14) <br />01/16/2018 -Council Agenda <br />23152.08600\1329338.8 <br />150 <br />
