1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />lution No. R-38-18 <br />Council Resolution: CEQA Findings DAP 001-228 <br />3 of 105 <br />WHEREAS, a Draft Environmental Impact Report ("Draft EIR") was prepared, <br />incorporating comments received in response to the NOP; and <br />WHEREAS, in accordance with State CEQA Guidelines section 15085, a Notice of <br />Completion was prepared and filed with the Office of Planning and Research on August <br />3, 2017; and <br />WHEREAS, as required by State CEQA Guidelines section 15087(a), the City <br />provided Notice of Availability of the Draft EIR to the public at the same time that the City <br />sent Notice of Completion to the Office of Planning and Research, on July 24, 2017; and <br />WHEREAS, during the public comment period, copies of the Draft EIR and <br />technical appendices were available for review and inspection at City Hall, on the City's <br />website, and at the Colton Public Library (Main Branch), and the Colton Public Library <br />(Luque Branch); and <br />WHEREAS, pursuant to State CEQA Guidelines section 15087(e), the Draft EIR <br />was circulated for a 45 -day review period from August 7, 2017 and September 21, 2017; <br />and <br />WHEREAS, during the 45 -day public comment period, the City consulted with and <br />requested comments from all responsible and trustee agencies, other regulatory agencies, <br />and others pursuant to State CEQA Guidelines section 15086; and <br />WHEREAS, the City received twenty (20) written comment letters on the Draft EIR, <br />including an acknowledgement from the State Clearinghouse that the City has complied <br />with CEQA environmental review requirements; and <br />WHEREAS, pursuant to Public Resources Code section 21092.5, the City provided <br />copies of its responses to commenting public agencies at least ten (10) days prior to the <br />City's consideration of the Final EIR on April 3, 2018; and <br />WHEREAS, on May 4, 2018, the City gave public notice of the City Council's <br />public hearing by advertisement in a newspaper of general circulation, and posted the <br />public notice at City Hall, and mailed to all property owners within 300 feet of the project <br />
