0 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Colton City Council Ordinance No. 0-02-18 <br />January 16, 2018 — Page 2 of 5 <br />California Environmental Quality Act (CEQA), finds that, pursuant to the California <br />Environmental Quality Act ("CEQA"), CEQA Guidelines § 15164, a lead agency may prepare an <br />addendum to a previously approved 2013 General Plan Environmental Impact Report (EIR) if only <br />minor technical changes or additions are necessary and none of the conditions described in CEQA <br />Guidelines Section 15162 have occurred. An Addendum to the EIR has been prepared and findings <br />certifying the proposed Addendum to approved EIR will be considered by the Planning <br />Commission., and <br />WHEREAS, on October 17, 2017, the City Council directed staff to bifurcate the project <br />by removing the East K Street properties in order to address the pending Conditional Use Permit <br />application at 190 E. K Street. Staff has removed the East K Street properties as directed by City <br />Council to be heard as a separate item at a future date. <br />WHEREAS, on January 16, 2018, the City Council of the City of Colton ("City Council") <br />held a duly noticed public hearing at which time all persons wishing to testify in connection with <br />the application were heard and the application was comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. Incorporation of Recitals. The City Council hereby adopts the recitals and <br />findings set forth above and in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City <br />Council and all written and oral evidence presented, including the staff report and the findings made <br />in this Ordinance, the City Council hereby finds and determines that the proposed Ordinance is <br />consistent with the goals and policies of the City of Colton General Plan, or will be consistent upon <br />the concurrent adoption of an Amendment to the General Plan, and is reasonably related to the <br />public welfare of the citizens of the City and surrounding regions. Specifically, the provisions of <br />this Ordinance implement General Plan policies and/or reclassifies properties into appropriate <br />zoning classifications, which will be consistent with new general plan land use designations, which <br />furthers the City's goals and policies as set forth in the City of Colton General Plan related to South <br />Colton neighborhoods, specifically: <br />1. The proposed Change of Zone is consistent with the overall objectives of the Colton <br />General Plan. Changing the existing zoning designations from these properties and <br />applying zoning designations that will revitalize residential neighborhoods, preserve <br />existing single family homes and eliminate to reduce conflicts between industrial <br />activity and residential neighborhoods. The proposed change of zones are consistent <br />with the following policies in the Land Use Element of the General Plan: <br />Changing M-2/SDA (Heavy Industrial/Sensitive Development Overlay) Zoning <br />designations to C-2 (General Commercial) Zoning designation is supported by: <br />-2- <br />
