Colton City Council Ordinance No. 0-02-18 <br />January 16, 2018 — Page 4 of 5 <br />1 approved 2013 General Plan Environmental Impact Report (EIR) if only minor technical changes <br />or additions are necessary and none of the conditions described in CEQA Guidelines Section 15162 <br />2 have occurred. An Addendum to the EIR has been prepared and findings certifying the proposed <br />3 Addendum to approved EIR will be considered by the City Council, and <br />4 SECTION 4. Based on the entire record before the City Council and all written and oral <br />evidence presented to the Commission, the Commission finds the Zone Change is reasonably <br />5 related to the public welfare of the citizens of the City of Colton and the surrounding region, <br />pursuant to Title 18, Section 18.22 "General Commercial Zone is intended to permit a wide range <br />6 o retail and commercial services, professional offices, and medical <br />f p f ff facilities. The General <br />7 Commercial designation supports higher -intensity commercial uses such as fast food and sit-down <br />restaurants, offices, auto services, and community -wide and regional retail establishments. Since <br />8 many of these uses tend to be large in scale, appropriate locations provide regional exposure, high <br />traffic visibility, and contain sites capable of accommodating expansive poor area and customer <br />9 parking. The General Commercial designation should not apply to areas along low-volume <br />10 residential roadways or in the midst of a residential neighborhood, " and Section 18.12 "Low <br />Density Residential Zone is characterized generally by single-family detached homes on individual <br />11 lots that form a cohesive neighborhood, residential subdivisions in this category are similar to <br />those found in many of Colton's established residential tracts. Within this designation, clustering <br />12 of dwelling units may be allowed through discretionary permit process to provide additional <br />opportunity for a diversity of housing types and architectural styles and common open space areas. <br />13 New development must be compatible and similar in character to the surrounding residential <br />14 neighborhoods within this designation. " <br />SECTION 5. Based upon the findings set forth in Sections 1, 2, and 3 of this Ordinance, <br />15 the City Council hereby approves the following Change of Zones: <br />16 . 134 East K Street (APN: 0163-081-12) — Change of Zone from M-2/SDA (Heavy <br />17 Industrial/Sensitive Development Area Overlay) Zone to C-2 (General Commercial) Zone; and <br />18 • 146-162 East K Street (APNs: 0163-081-13 & 14) — Change of Zone from M-2/SDA (Heavy <br />Industrial/Sensitive Development Area Overlay) Zone to R-1 (Low Density Residential) Zone <br />19 identified in attached map — Exhibit -"A." <br />20 SECTION 6. Invalidity. If any sentence, clause or phrase of this Ordinance is for any <br />reason held to be unconstitutional or otherwise invalid, such decisions shall not affect the validity <br />21 of the remaining provisions of this Ordinance. <br />22 SECTION 7. Effective Date. This Ordinance shall become effective thirty (30) days after <br />23 its adoption in accordance with the provisions of California law. <br />24 SECTION 8. Certification/Publication. The City Clerk shall certify to the passage of the <br />Ordinance and cause the same or a summary thereof to be published within fifteen (15) days after <br />25 adoption in a newspaper of general circulation published and circulated in the City of Colton. <br />26 <br />27 <br />28 <br />-4- <br />
