R-57-18 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA APPROVING AN ADJUSTMENT <br />TO THE CITY'S SOLID WASTE COLLECTION, <br />RECYCLING AND DISPOSAL RATES, EFFECTIVE JULY 1, <br />2018. <br />WHEREAS, the City of Colton ("City") operates a municipal solid waste <br />system that transports and disposes of all solid waste and recyclable materials collected <br />residential, commercial and industrial customers within the City; and <br />WHEREAS, pursuant to Colton Municipal Code Section 6.16.025, on March 7, <br />2017, the City granted an exclusive franchise ("Franchise Agreement") to CR&R for the collection, <br />transportation, processing and disposal of solid waste and recyclable materials generated within <br />boundaries of the City; and <br />WHEREAS, on December 19, 2017, at 6:00 p.m., the City Council conducted <br />duly noticed public hearing pursuant to California Proposition 218 (California Constitution Article <br />XIIID, Section 6), where it considered a rate schedule to be charged to residential, commercial and <br />industrial customers within the City for solid waste services, in accordance with the Franchise <br />Agreement; and <br />WHEREAS, pursuant to California Proposition 218 (California Constitution <br />Article XIIID, Section 6), at least 45 days prior to the hearing, the City mailed, postage prepaid, a <br />notice of the public hearing on the proposed solid waste rate schedule to the property owner of each <br />identified parcel upon which the rates were being proposed, and <br />WHEREAS, said notice identified: (1) the amount of the increased rates to <br />charged; (2) the basis upon which the rate increase was calculated; (3) the reason for the <br />increase; and (4) the date, time, and location for the public hearing on the rate increase; and <br />WHEREAS, all those wishing to be heard were afforded an opportunity to be heard, <br />and at which time the City Council considered any and all written protests concerning the <br />solid waste rate schedule; and <br />-1- <br />
