1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the City did not receive written protests from a majority of <br />identified parcels that would be subject to the proposed rate increase; and <br />WHEREAS, the City Council therefore approved the rate schedule that evening <br />a five to two vote; and <br />WHEREAS, pursuant to Government Code section 53756, the rate schedule <br />approved by the City Council on December 19, 2017 authorized automatic annual increases in <br />service rates for the next four (4) fiscal years based upon two factors (i) the annual percentage <br />increase in the Consumer Price Index, all Urban Consumers, for the Los Angeles County -Riverside <br />County -Orange County Statistical Area, for the month of March, as determined by the United States <br />Department of Labor Statistics, or its successor ("CPI"), and (ii) any changes in County landfill <br />"tipping" fees, subject to a maximum adjustment of 5% per year; and <br />WHEREAS, pursuant to Colton Municipal Code Section 6.16.240 and the <br />Franchise Agreement, CR&R has requested an approximately 1.33% adjustment to the rates to <br />charged for Fiscal Year 2018-2019 (effective July 1, 2018) to residential, commercial and <br />solid waste collection and disposal services due to CPI; and <br />WHEREAS, the Franchise Agreement allows for adjustments in solid <br />collection rates due to increasing costs, including but not limited to the following: (i) solid waste <br />disposal charges at landfills (so called "tipping" fees), (ii) fuel costs, (iii) AB 939 and other statutory <br />recycling and diversion compliance costs (including recycling facility fees), (iv) other operational <br />costs in providing solid waste collection services, as well as (v) CPI; and <br />WHEREAS, the City Council finds that the Fiscal Year 2017-2018 rate schedule <br />and the proposed 2018-2019 rate adjustment correspond to the amount necessary for the collection, <br />conveyance, recycling and disposal of solid waste via the City's Franchise Agreement with CR&R. <br />Therefore, the City Council finds, with respect to the revenue derived from the solid waste rates, <br />that (1) there is a reasonable relationship between the use of the rates increased herein and the <br />-2- <br />
