Consensus by <br />Councilmembers presented; no objection; and so ratified. <br /> <br /> District 2 – Appreciation for Service - Code Compliance and Housing Appeals Board – Jules Carvalho <br />Jr. <br />CM Cisneros presented a Certificate of Appreciation for his Service to Commissioner Jules Carvalho Jr. <br /> <br />PUBLIC COMMENT <br />The following community members addressed the Council: Jessica & Adrianne from Electric Department. <br /> <br />Mayor DeLaRosa requested Public Hearing Item 12 be brought forward for discussion and action; consensus by <br />Councilmembers present; no objection. <br /> <br />PUBLIC HEARINGS <br /> <br />(12) Commercial Marijuana Cultivation <br /> <br />TIME AND PLACE FIXED TO CONSIDER A PUBLIC HEARING TO WAVE FULL READING, <br />READ BY TITLE ONLY AND INTRODUCE AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, AMENDING CHAPTERS 18.06.160 AND 18.48.130 AND ADDING A NEW <br />CHAPTER 18.48.134 ESTABLISHING PERMITTING PROCEDURES FOR COMMERCIAL <br />MARIJUANA CULTIVATION BUSINESSES AND OTHER COMMERCIAL MARIJUANA <br />ACTIVITIES AND ADOPTING A CHANGE OF ZONE TO APPLY A MARIJUANA <br />CULTIVATION CANDIDATE SITES (MCCS) OVERLAY ZONE (FILE INDEX NO. DAP-001-426). <br /> <br />Mayor DeLaRosa declared the Public Hearing Open. <br /> <br />City Clerk Padilla submitted the Notice of Public Hearing (on file in the City Clerk’s Office) and announced no <br />protest or objections received thereto. <br /> <br />STAFF PRESENTATION <br />Victor Ponto of BB&K and Mark Tomich, Development Services Director, presented for Council consideration <br />and approval of staff’s recommendation and/or direction; with the assistance of a PowerPoint presentation: <br />‘Proposed City of Colton Marijuana Ordinance.’ <br /> <br />PUBLIC COMMENT <br />The following community members addressed the Council: Gem Montez and Christine Irish- Ré. <br /> <br />Motion and Second by CM González/CM Navarro to close the public hearing. <br />Vote: Unanimous <br /> <br />COUNCIL DISCUSSION <br />Mayor DeLaRosa made opening remarks: increase in the general fund; new subject matter to the City of Colton <br />and the State of California; and the city will continue to work hand in hand on the state level and as it relates to <br />the cities within the State of California. <br /> <br />Discussion and discernment proceed by Councilmembers present with clarification provided by staff: D irector <br />Tomich and Victor Ponto; main concerns centered on the initial recommendation of the City’s Ad Hoc <br />Committee (CM Woods/CM Suchil/Mayor DeLaRosa) vs. the final recommendation by the Planning Commission: <br />marijuana cultivation candidate sites overlay zone; and the future of business development in the sites <br />recommended.
