R-97-17 <br />A RESOLUTION OF THE OF THE CITY OF COLTON CITY COUNCIL <br />APPROVING CONDITIONAL USE PERMIT TO ALLOW A TRUCKING COMPANY <br />TO PARK/STORE/DISPATCH FIVE SEMI -TRUCKS WITH NO TRAILERS AND <br />ARCHITECTURAL AND SITE PLAN REVIEW TO CONSTRUCT NEW 750 SQUARE <br />FOOT OFFICE, 600 SQUARE FOOT REPAIR SHOP, AND 2,041 SQUARE FOOT <br />COVERED TRUCK BAY AREA ON (FILE INDEX NO. DAP -001-394) PROPERTY <br />LOCATED PROJECT SITE MEASURING 15,000 SQUARE FEET IN AREA WITHIN THE <br />M-2/SDA (HEAVY INDUSTRIAL/SENSITIVE DEVELOPMENT AREA OVERLAY) <br />ZONE. (APPEAL FILE INDEX NO. DAP -001-459) <br />WHEREAS, on September 12, 2017, the City of Colton Planning Commission conducted <br />a public hearing, considered public testimony and denied Conditional Use Permit for truck storage <br />and office use and Architectural and Site Plan Review to construct new 750 square foot office, <br />600 square foot repair shop, and 2,041 square foot covered truck bay area, on property located at <br />190 E. K Street on project site measuring 15,000 square feet in area within the M-2/SDA (Heavy <br />Industrial/Sensitive Development Area Overlay) Zone; and <br />WHEREAS, the City Council concurrently reviewed the applications for a Conditional <br />Use Permit for truck storage/office use and Architectural and Site Plan Review for various site <br />improvements/buildings/walls/landscaping; and <br />WHEREAS, on December 5, 2017, the City of Colton City Council conducted a public <br />hearing on the Application and all persons wishing to testify in connection with the proposed <br />Application were heard, and the application for Conditional Use Permit and Architectural and Site <br />Plan Review were comprehensively reviewed; and <br />WHEREAS, Pursuant to CEQA Guidelines Section 15303 — New Construction or <br />Conversion of Small Structures - This section pertains to new construction , categorically <br />exempting from CEQA proposed projects that involve negligible or no expansion beyond what <br />currently exists at the time of enviromnental determination. <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. <br />BE IT NOW THEREFORE RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF COLTON: <br />SECTION 1. Based on the entire record before the Planning Commission and all written <br />and oral evidence presented, including the staff report, the Planning Commission makes the <br />following Conditional Use Permit/Sensitive Development Area Overlay findings in accordance <br />with the Colton Municipal Code. <br />That the proposed Use is in accord with the General Plan, the objectives of this <br />title, and the purposes of the zone in which the site is located; The proposed <br />Trucking Use are consistent with the following General Plan Update goals and <br />objectives: <br />
