The Applicant shall defend, indemnify, and hold harmless the City of Colton and its officers, <br />employees, and agents from and against any claim, action, or proceeding against the City of <br />Colton, its officers, employees, or agents to attacks, set aside, void, or annul any approval or <br />condition of approval of the City of Colton concerning this project, including but not limited to <br />any approval or condition of approval of the city council, planning commission, or development <br />services director. The City shall promptly notify the Applicant of any claim, action, or <br />proceeding concerning the project and the City shall cooperate fully in the defense of the matter. <br />The City reserves the right, at its own option, to choose its own attorney to represent the City, <br />its officers, employees, and agents in the defense of the matter <br />PLANNING DIVISION <br />2. This approval is for a Conditional Use Permit to allow a truck storage use to store five tractor <br />trucks, office and service bay; An Architectural and Site Plan Review to construct new 750 <br />square foot office, 600 square foot repair shop, and 2,041 square foot covered truck bay area, <br />on property located at 190 E. K Street on project site measuring 15,000 square feet in area <br />within the M-2/SDA (Heavy Industrial/Sensitive Development Area Overlay) Zone, as shown <br />on the plans stamped and dated November 14, 2017 by the Development Services Department, <br />except as amended by the conditions herein. <br />Any requests for modifications, including any deviation from the approved plans and/or <br />conditions of approval, shall be submitted to the Development Services Director for review, <br />prior to implementation of the modification. Significant deviations from the approved plans or <br />conditions of approval shall be subject to review and approval by the Planning Commission. <br />The applicant requesting the modification shall supply information deemed necessary by the <br />Director and/or Commission to make a determination. <br />4. Prior to implementation of this approval, plans shall be submitted to the Development Services <br />Department for review and building permits and/or other appropriate permits shall be obtained. <br />5. All signs shall conform to the Sign Code, including letter height for wall signs. <br />6. Any plans submitted for building plan check and construction plans for this project shall contain <br />an exact reproduction of these conditions of approval on one of its sheets. <br />7. Prior to the start of business operations, the operator shall obtain a City Business License upon <br />final approval (occupancy) of a Business Occupancy permit (BOP). <br />8. The applicant shall have all tractor trucks at all hours only access (ingress and egress) the <br />property the property from 9th Street driveway area. <br />9. The applicant shall only store a maximum of five tractor trucks on the property at any time. <br />
