R-62-17 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, CALIFORNIA SETTING A PUBLIC <br />HEARING TO CONSIDER THE CONVEYANCE OF THAT <br />CERTAIN REAL PROPERTY LOCATED ALONG LAUREL <br />STREET (ASSESSORS PARCEL NO. 0160-241-45) TO <br />THERMAL COMBUSTION INNOVATORS INC. (THOMAS <br />HAYWARD) PURSUANT TO CALIFORNIA <br />GOVERNMENT CODE, SECTION 37420 ET SEQ <br />WHEREAS, the City of Colton, a California municipal corporation ("City"), is the owner <br />of real property generally located at along Laurel Street in the City of Colton identified as <br />Assessor Parcel No. 0160-241-45 ("Property"); and <br />WHEREAS, the Property was previously used as a utility substation and was the subject <br />of an option agreement entered into between the City of Colton and the San Bernardino County <br />Transportation Commission that requires the City to transfer the Property to an adjacent property <br />owner; and <br />WHEREAS, California Government Code Sections 37420 through 37430 authorize the <br />City to dispose of public property; and <br />WHEREAS, California Government Code Section 37421 provides that when the City <br />finds that the public interest and convenience require the conveyance of City property, the City <br />may adopt a resolution stating such finding and intention to convey the property; and <br />WHEREAS, California Government Code Section 37422 provides that such resolution <br />shall fix a time for hearing protests to the property conveyance, provide for publication of notice <br />of the hearing, fix the time when the City will take final action regarding the property conveyance <br />and contain an accurate description of the property to be conveyed; and <br />WHEREAS, California Government Code Section 37423 requires publication of this <br />Resolution in a daily newspaper circulated in the City and posting of this Resolution in three <br />conspicuous locations on the Property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />COLTON: <br />SECTION 1. RECITALS. The City Council does hereby find and affirm the above -noted <br />recitals are true and correct and hereby incorporated in the body of this Resolution as if restated in <br />full. <br />SECTION 2. FINDINGS. The City finds that the public interest and convenience require <br />conveyance of the Property to THERMAL COMBUSTION INNOVATORS INC. (THOMAS <br />HAYWARD) in accordance with the terms of the Option Agreement for economic development <br />- 1 - <br />
